Not at all how this is going. The stops are made when a deer carcass or parts are visible. These aren’t checkpoints.

Regulatory checks of commercial vehicles do NOT have to be random. They can check cargo and bill of lading in addition to all the typical stuff with lights, brakes, weight, time in service. Yeah, I know this is not the topic of the post but there is an incorrect post above about DOT checks.

Eh, idk. These clearly are not “plain view” observations. What happens if there’s dope in the truck that an officer observes only once the vehicle is stopped? Hopefully the state is prepared to overlook that contraband in the name of CWD prevention. I don’t question the motives or the intent here, but I’m honest enough to recognize a 4th amendment concern.

If the officer observed the " contraband" in the vehicle, how is that not "plain view"?

The basis of 4th amendment rulings in aerial surveillance has been that anyone could have been flying at 400 ft or 1000 ft and seen the contraband, here, not so much.

A skull and horns is observed. A stop is made, they open the cooler to see if the meat is deboned and boom, there’s a human head.

The case will drag on for years but that’s a bad stop at the end of the day.

What was the basis for the stop, officer, that lead to you viewing the contraband?

Not sure I'm following you. What I'm saying is the GWs saw a deer or horns in the bed of a truck. GWs stop the truck check hunter for license, tags, transport tag ,confirmation number are whatever is need for the area you are hunting. GW walks up to window to initiate conversation with the driver. Officer sees a bag of a weed or small bag of pills. Would not the plain view doctrine come into play here?

I hunt on my land that on the state line . My access road goes back into Tennessee before going back into Alabama . Is it legal for me to bring a deer out that road.

According to people in the know. Deer know lines, so if it's a Bama deer that crossed the line and you shot it in Tennessee. It's still a Bama deer, so it should be legal.

So you’re ok with people illegally transporting deer parts into the state that could potentially be carrying CWD prions? I fail to understand this reasoning. It is VERY important to our resource that it be prevented from reaching our borders. I’d say more important than a few road hunters.

The thought has crossed my mind about quitting and going back to fishing, but I usually shoot most of the deer I see with my camera now days and may kill one or two a year. This CWD, deboning, has really taken a lot of the enjoyment out of hunting. I didn't go this perfect afternoon just because of the thought of having to cut up and debone a deer in the field. If I had a place to do all of that in Tennessee it wouldn't be so bad. And just like TexasNative said they did the same setup two years ago at the state line on 231.

Apparently they were monitoring I22 at the Mississippi line this afternoon.

That’s because they know that hat on the dash ain’t yours..... too small.

So, when our state finds the first case of CWD in a free range killed deer we will hear that the state didn't do enough to protect our state's herd. Spending money on scissor lift rentals will be the least of our worries.
