What about a mother whose son is having a medical issue and needs medical attention. She speeds to the hospital. Should she be ticketed?

Scenario A: Fred gives the Old Man a citation. The law's the law. Period.
Two months later, a rapist is loose in the area. Or a robber who is beating up women. All law enforcement is combing the area. Fred knows the Old Man and his grandson know a lot of people in the area, attend the local church and are pretty plugged in.
Fred drops by. Old Man tells Fred to get screwed. Grandson tells him to get screwed. Rapist attacks three more people including a 12-year old girl before being caught.
Scenario B: Fred doesn't write a citation and uses discretion. Knows the Old Man ain't a road-cruising, baiting POS nighthunter who causes problems like some of the other trash in the area.
Old Man is grateful. Figures he did what he had to do and might have to do it again to feed his family, but is grateful for the common sense and discretion.
Fred drops by two months later while canvassing the area to help in the search of the rapist. Old Man's grandson has told the old man about some chatter at the local hangout. It's just chatter, but there's a familiar nickname or two in it.
Fred passes along those nicknames to his other LEO sources, who follow up with their people and make arrests four days later. It also helps clear up three other crimes two counties away where the POS criminals did their mischief.
Fred doesn't go back to visit the Old Man until maybe the deer hunting season when he drops by to see how his season is going. Old Man is grateful for not receiving a citation, has some hot coffee and a pot of deer stew from a legally-killed doe, and his grandson has taken the Hunter Ed course offered so he'll be legal, too. Grandson mentioned something about maybe going into law enforcement to help other people.
Common sense discretion, or be a hard-ass?
It ain't always cut and dried.
So should all LEOs give warnings for not-so-serious crimes in the event that a more serious crime happens down the road? I don't think I understand your point here.

They do give warning all the time...and they also do not write all the tickets they can in most scenarios unless they have a reason to. ...multiple offender comes to mind. That is another example of using discretion just from the other side of the argument.
I'd be interested to hear if BhamFred ever found himself that side of the "discretion" discussion. Ever caught a known repeat poacher and wrote him for everything you could think of?

heck I've gotten 3 warnings in the last year  ...been pulled over more in the 12 months I have lived in TN that in the rest of my life combined.

Some of ya'll don't think there are folks that poor in Alabama, what rock do you live under??? I worked Greene and Hale Counties for several years. I promise you there are folks that are poor as all hell, and too proud to work the system.
I used to carry squirrels to a twenty something year old black man to clean on halves. I carried him some ducks one day and he said he didn't do ducks but I might see a neighbor, Miss Estelle.
I went by her house. Ya'll in the country have seen ones like this. Old. Wood. Needed paint. Broom swept dirt yard with whitewashed rocks around it. I met Estelle and asked her about the ducks on halves. She agreed and I left. Picked em up next day all cleaned and washed, well, 1/2 of them.
She was near 70, raising half dozen younguns, none of them hers. Some grandchildren and some neighbor kids who got dropped off. Oldest girl was 19 and attending college in Tuscaloosa and working two jobs, and living at home. She didn't "play the system", but did cleaning jobs and such for money.
I'll bet she couldn't of raised $300 if her life depended on it.
I carried her every piece of meat from confiscated animals and donated some deer I killed. I took her 300 pounds of yellow catfish that was confiscated from some telephoners. She took some of it and distributed the rest to other poor families around Akron.
Damn fine hard working POOR woman.....
Ya'll that say a ticket should be written for ANY violation need to get put from under yer rock more often.....
1982 er so I spotted an old car parked off the Lock Eight road near Akron. There was small cypress pond back there. I eased out of the truck and walked to the water. I spotted a 50'ish black woman fishing, along with five younguns fishing around her. I approached them and all went quiet. She was of those old country folks that won't look up as you as they talk.
I noticed she had a gallon milk jug next to her near full of squirming 5-7 inch mudfish. I asked her what she was going to do with them She replied "we eats em"....
Any of ya'll that know mudfish and have tried to eat one knows how hungry someone must be to "eats em"...
I told em to careful of snakes and walked back to the truck...
Damn boys, now that is POOR.....l

An officer can never know the entire story of a situation like some of these. Maybe the old man was poor and refused to take government assistance and decided to take what he believed was an animal that God provided at the time to fill his family needs.
Maybe he was a welfare sucking,dope head who had nothing because he smoked it all up and decided since the last 10 times he was arrested he got off easy so why not?
What about an individual who loses his license due to paperwork mix up. He loses his license but cannot drive to work or the DMV to sort out the problem.
What about a man who claims it was a mixup so he can get out of a ticket but it really wasn't. He was headed to the store to get more beer.

By the way for all you anti discretion folks, we had a place on our monthly and weekly reports for "warnings" given. A warning was to be given only for an actual violation that we officers felt didn't deserve an arrest. DISCRETION. As directed by none other that the Montgomery office of ADCNR, from the chief down the line.
I sure some of ya'll think you are more qualified to make descisions on whether or not we officers should make discretionary warnings...but contrary to your thinking....YOU AREN"T.
The only second thoughts I EVER had about writing tickets was about some early in my career that later I felt a warning would of worked as well.
I feel that a GWs job is to gain compliance with the laws/regs of the state of Alabama. By any legal means. By what works best in that particular instance. Put em in jail. Write em a ticket. Give a written warning. Give a verbal warning. By education thru talking and thru classes. Whatever works.....

I've seen poor & been poor, and I know that some of what we call poor are well-to-do by standards in other places. I've been hungry too, but thank God I never had to eat mudfish. I've received mercies that I didn't really deserve, and denied mercy to some who did deserve it, but I try to remember that but for the grace of God, there I would be.

Lets say there's an 80 year old man that is in very poor health. He loves hunting but can't get out and scout, plant fields, or hang stands. Don't have but a few acres but they need deer for the freezer. He sets out some corn to get him a doe. Gw walks up. Gives him a ticket. Can't you just let this one slide? What's your opinions. little odd that ole Darin never responded.

I uderstand LEO using discretion, and totally agree with them doing so. However, I just don't understand how when determining what to do with the guy that they could foresee things two months down the road.

You don't, or cant, forsee things.
But LEOs everywhere use discretion, sources, trust (to a degree) and other means of making or solving cases, or gaining info. It's not a matter of being a mind-reader or seeing into the future. It's common sense and discretion, and possibly down the road that pays off in other ways.

I would have hated to have watched Sudden Impact with some of the folks on aldeer. They would have wanted Harry to arrest the Sondra Locke character and have her executed. Still, Fearless Fosdick would have gunned down all the lawbreakers, including the old woman catching the grinnels. He saw his job as fighting crime, and that's what he did. To achieve Superhero status, you gotta see things as black or white. Does anybody here even know who Fearless Fosdick is? I think my jokes are going right over your heads.
