I can't say what I would do because I have never served in a law enforcement position of any type and therefore have no experience to rely on. To say that you are going to act a certain way every time is unrealistic because you have added human emotion to the situation. I respect officers that shows no favoritism but at the same time I respect people like Troy that while trying to do his job to his best ability also has the common sense to show discretion. Regardless of whether or not you like it law's are not always black and white. If they were there would be a whole lot less court cases because it wouldn't matter why you did something just whether or not you did it. Reb may not have ever tried to squirm out of a ticket but I guarantee you he has seen a cop and let off the gas while hoping the cop let it slide. We all have. Under his argument that he can live with the consequences of his actions he shouldn't do this because that's hoping he doesn't get caught just like the old man would hope he doesn't get caught with the doe. I don't blame the old man for doing what he did, just like I don't blame mexicans that cross our borders illegally to try and feed their family. I know, do it legally. Ever know anyone that tried to do it legally? It can take years. I'm not trying to turn this into an immigration thread. I'm just saying that when you look at your wife and kids and see hunger in their face you will do anything. I actually respect the old man that did what he did. He is trying to take care of his own. He didn't rob a bank like doekiller said. He shot a doe. Did that hurt you? Did that take something from you? Don't give me that crap about the die belonging to the people of the state, did it take money out of your pocket, like the owner of a convenience store that gets robbed or the insurance company that has to cover the theft? So what does all this rambling mean? Nothing. I can see both sides but would hope I can let common sense prevail if ever put in a situation like that.

I'm ok with officer discretion, but if I were the officer in this case as it's written I would give him a ticket. He did not sieze an opportunity to kill a deer out of his garden, he premeditatedly put out corn with the intention of breaking a law (I think baiting should be legal.) He should be punished just like anybody else. Judges are not given discretion as to whether somebody is guilty, that's what juries are for if you push the issue. Judges have the discretion to decide punishment.
Bad laws should be changed, not broken.

the last thing you want is a by-the-letter-of-the-law officer....
I wrote the chit out of tickets when working. I might of let that one slide.
When I was in Greene Co my partner, Harvey Foster, and I rode up by a shack of a house biy first seeing light. An 80 or so year old black man and his 10 year old grandson?? were just starting to skin a yearling doe. They had a big old pot on a fire next to them. They had that deer-in-the-headlights look when they recognized the warden truck.
The old man shot the doe(out of season) just before daylight with a flashlight(nighthunting) in his garden with a .22rf(illegal weapon). They lived in a POS shack you could throw a cat thru the walls.
I got out and talked to the old man for a minute er so. I told him to carry the deer out back so I couldn't see it and got back in the truck. Harvey agreed. We left. I could of wrote him a sack of high paying tickets, but there are more important things in life than writing those tickets.....
and nobody in Greene Co thought of me as easy on violators....quite the opposite.
I never had a second thought about what we did and would do it again tomorrow...
troy Good stuff! nope, you wouldn't let it slide if he walked into a grocery store and stole a few ribeyes would you? Perhaps that doe is what prevented him from walking into a grocery store and stealing a few ribeyes...or worse robbing someone at gunpoint for cash to buy food. Its nice to see someone that understands just because something is illegal doesn't make it wrong, and conversely just because something is legal doesn't make it right. I have said it before if we could measure morality we would not need laws. ...just lock up folks when they reached a certain point on the morality meter.

If I get caught speeding I can live with it. I don't do anything I can't live with the consequences. I expect no more or less from anyone else. People need to quit being a victim of their actions.
(I know you have excused yourself from the thread so I don't expect a reply, I'll throw it out there anyway.) What makes you think the old man wasn't prepared to live with the consequences of shooting that doe? he didn't run, he didn't deny anything, he didn't shoot the officer when approached.

Ummm, what about officers using discretion in another way? What if they stopped you for having been involved in a crime and there was no evidence ... so they planted some? He just knows you are guilty so he just uses his discretion. Law enforcement aren't trained as judges but, unfortunately, often they want to practice being a judge.
Either enforce the law or your breaking your oath. The judge could use his discretion and let the perp off light but law officers aren't judges and shouldn't act like one.

That is not discretion bill that is breaking the law.
Letting someone off with a warning or attempting to minimize penalty is not illegal. Planting evidence is highly illegal, and should be dealt with accordingly.

We had an older crippled up black man who hunted our land...he owned 20 acres in the middle of it...but he wandered all of it...he'd kill a deer...horns / season didnt matter,go home and get a wheelbarrow which was his nickname...he carried an old single shot 12 gauge...taped forearm and all (about a 2 mile walk home to get his wheelbarrow)...sometimes if we saw him we'd take it home for him and we gave him meat sometimes...but he NEVER asked for help....never...he and his family ate everything except the bleat...We had the hardest ass GW to ever set foot in MS...David Green...(who at one time was biggest outlaw in that part of the world)...David overlooked him...which I agree with...he survived off deer and other wild game meat and his garden (which he had hell with deer eating it)...he didnt waste an ounce...he'd clean them in he bathtub INSIDE his house...I do think theres a difference between somebody being lazy and greedy vs someone who needs the meat

Quick scenario . u r an Leo patrolling an inner city area that is drug and gang infested and very poor. you get to know the kids in the area and one kid job particular you always see and talk to and is a good kid. he stops you one day and says my friend let me ride this mo pad and I'm not sure its. his and it might be stolen. do you mind running a check on it for me and see if it is stolen? well come to find out it is stolen. would you put the kid in jail for a felony receiving stolen property?
