The next time you are pulled over by a LEO for failure to use a turn signal and he wants to give you a warning, tell the officer that you dont believe in officer discretion and would like for him to do his job and go ahead and give you a ticket. Or if your speeding taking your kid with a broken arm to the emergency room, the officer gives you an escort instead of sitting on the side of the highway for twenty minutes running your license and tag. Been there done that.

LEOs have to have some discretion. They cant give tickets to every speeding car, or every J-walker. Its being human and using common sense. You just want to argue.

Lack of character would be taking an old man thats trying to feed his family and confiscating his gun and truck and giving him time in jail because he cant pay the fines you put on him. I am with Reb, all of you are saying basically that you don't think that it is a big deal because you view it as a minor law. I have a lot of clients that rob banks or stores because their families are hungry and they have no money. Where do you draw the line?? What if the old man robbed the gas station?

Also, trying to get out of a ticket doesn't mean that you are not guilty and didn't deserve it.

Thats exactly why the LEO has to be able to use some discretion. If the old guy is holding up the gas station theres a good chance somebody is going to get hurt.

I kinda figure most people holding up places at gun point are doing it because they need money not just for the fun of it.

Try to get out of a ticket is simply asking the LEO to use his discretion. Ive never known of anyone that got a speeding ticket that was not speeding.

Officers are hired to enforce the laws like you said but there is officer discretion. Its no different than a judge handing down a ruling? Judges do not write laws but they instead use discretion just as an officer must use it. Its not always seeing the bad in everyone yes they are breaking a law but its about giving everyone a fair chance. If LEO's were all the time an a$$ and never used discretion then how would the public react? The public would automatically say "well all of those officers are a$$es they never help anyone no matter the circumstances. Its not necessarily picking and choosing when and where to enforce the laws its realizing who could use some help not putting them even father down than they already are. Just my 2 cents.

Judges use discretion in sentencing someone, but not in guilt. If the judge heard this case and the man offered an excuse for doing it, then the judge is going to find him guilty every time. he may not give him much of a punishment, but he is going to be guilty.

i dont see any thing wrong wit shooting one out of your garden at nite, its the sob that rides the roads shooting one out of other peoples yards and gardens at nite that need prosecuting
