For DK, Jaw and Troy, what does "Receiving stolen property 3rd" exactly entail under Bama law? Also, a $200,000 cash bond seems kinda low for a murder charge. Especially given that the old man got a $50,000 bond for just the obstruction. Any thoughts on that??? If a person possesses stolen goods he is guilty of Receiving Stolen Property. At one time the law said just having the property is Prima Facia (sp?) evidence, but now it is pretty much accepted that in order to get a conviction, you have to show that they knew or should have known the property was stolen, for example, if you buy a $1500 rifle/scope combo for $150, you know it is stolen. They changed up the amounts since I retired so I'll have to defer to one of the current LEOs. As for the bond, that is probably what the bond schedule calls for. Unless there is evidence that is mitigating (flight risk, very extensive criminal history, threats to witnesses, etc.), the judges pretty much have to stick to the schedule.
Lord, please help us get our nation straightened out.
