Wardens exercise discretion all the time when they choose what to enforce and what not to enforce. In fact, their oath of office compels them to make those decisions. Constitution first, laws second if they comply with our constitution and the rules third if they comply with both. Why else would every individual game warden be required to swear in God's name to support our constitutions?

When our legislature and agency leaders violate their oath of office, then game wardens and all other peace officers have sworn to be the last in line to defend our constitutions.
