I wonder how many people have actually been cited at a G&F roadblock? The truth is for traffic safety roadblocks, sure they end up writing some citations, but that is not the main goal. The main goal is simply PR by letting the public know that seatbelts, DUI, proof of insurance, or whatever the focus of the roadblock may be is important.

You are no longer hunting while you are in your vehicle so unless you have a dead deer you don't need to have a license or harvest record or anything else on you.

Bam! That was SO many pages ago. Time flies when you're stupid.

However, that was in reply to the posit of a law enforcement officer asking for ID on a city sidewalk.

But yes, comparison made. Carry on.

Harvest record? How do they prove you didn't have it when you were hunting? Just because you don't have it with you when you are not hunting.

Pen? How do they know you didn't have a pen when you were hunting?

License? How do they prove you didn't have it on you when you were hunting?

Unless you has a deer in your truck and you have not recorded it on your harvest record or reported it to game check, there is no way for them to charge you with anything and have it not be thrown out.

Remember, they have to prove you guilty, you don't have to prove your innocent.
So, are you saying that a circumstantial misdemeanor case can't be made. Collect circumstantial evidence, confession, other evidence and go to the magistrate and get a warrant

So according to the ops plan, if you have a deer they check to make sure it is recorded. No problem there. That seems to be pretty solid evidence of hunting. Other than that they say it is for PR like I suspected.

No one has provided any proof that any tickets have been wrote on these roadblocks other than not recording deer on a harvest record, when there are dead deer in plain view in one of these vehicles at said road block

Again, the whole thing is "lightweight" stuff compared to what we go through on the military base.

There is the operative phrase. You are on a military base. Simply by being on the base you are under their control and subject to stop or search at any time. There is a world of difference if you are driving down a public road.

I seem to remember we made a couple of POSSESSION OF DOE DEER IN CLOSED SEASON cases years ago when I ran roadblocks in Jefferson Co.

Out west the Game Dept get together and run roadblocks on the interstates with multi state Officers present. They make a LOT of cases.

I've spent most of the money I've made in my lifetime on hunting and fishing. The rest I just wasted.....

To play devil's advocate on that statement is the fact that it is not the "public's" road. It is the state's. That is why they can require you to have a license to drive on it and require you to submit to a test to determine the alcohol content in your blood when charged with DUI and failure to do so will automatically lead to the suspension of your driving privileges for a period of 90 days. That is the Implied Consent law. Driving on the state's roads is a privilege not a right according to the law and courts.

I didn't think interstates could have roadblocks set up on them?

That is just for the interstates in Dallas County. grin

That I've never seen or heard of. It would be a nightmare to conduct and would probably involve extreme exigent circumstances.

they have done it for years Matt. Lots of planning and LOTS of folks helping so drivers aren't delayed for very long. If traffic backs up they just let everyone go till it lessens.
