This is what the 5th amendment is for. And the 4th. The 5th is all fine and dandy until you’re cornered by a gaggle of game wardens in downtown Kennedy, Alabama. The whole refusing to answer questions or allowing a search is just gonna piss them off. You gotta figure out a way to let them down easy. if you aren't hunting they have no right to search your vehicle and I would tell en. If that dosen't satisfy them, then tell em piss off. You do NOT have to allow a search if yer not carrying game. and for the LAST time there is no damn mention of the word PEN, or PENCIL in the regulation about Harvest Record. It is NOT ILLEGAL to not have a pen or pencil on you while hunting. You have to record the kill before moving it. You can leave it laying, drive home and get a pen, go back and record it LEGALLY. Just don't move it before recording. I reallly don't care what any LEOs personal "interpertation of a law or reg is, the ONLY thing that counts is what is written in the law or reg. Giving you a ticket for failure to carry a pencil is grounds for an illegal(false) arrest lawsuit. There ain't no damn such law.

roadblocks CAN be legally used, within Federal guidelines. A LOT of them are not legally run.
I've run legal roadblocks, ya just don't decide to, and throw one up without a plan, and without following guidelines.
I've spent most of the money I've made in my lifetime on hunting and fishing. The rest I just wasted.....

they (LEOS) cannot legally arrest you for refusing to allow a search of a vehicle unless you are in the act of hunting, they have a warrant, or they have exigent circumstances(meaning they have enough to get a warrant).
Wearing camo with a gun in the truck ain't enough probable cause to get a warrant, at least not in rural Alabama.

If I ever roll up on one of those roadblocks, I'd say there's better than 50% odds that I'm gonna get tazed. If I'm driving my truck down the road while wering camo, and have to play 50 questions about hunting at a road block, I'm gonna get a pissy attitude real quick. i wouldnt even speak id crack my window and give em my drivers license and refuse to even show anything to do with hunting since im driving and not hunting in the first place. Unless i got a deer in the back i might be in trouble dont think ive ever filled out a harvest record in my life

When we used to run roadblocks for sobriety checkpoints, we had to publish the date and location of checkpoint in the newspaper.Had to allow opportunity for public to avoid sobriety checkpoint. That's why once you go through it they can make you go through if you're part of the random selection. Might be different in AL.

It is a shame they put the part about the pen on that form, but that is not the law. The law doesn't say anything about a pen or pencil, it's already been posted here. They can print whatever they like and it doesn't matter, what matters is the law. Does show their lack of understanding the laws and regs though and really a lack of care in getting things done correctly because that has been on the form for several years.

I'm not a huge fan of game wardens but I do have respect for law enforcement and understand the crap they deal with every day. If I go through a road block I will do what they ask me to and go on my way. This mind set folks have about not respecting or complying with law enforcement rediculess.

This mind set folks have about not respecting or complying with law enforcement rediculess. The mindset of giving in to law enforcement requests in situations like this -- when you're driving down the road and have a GW ask for your hunting license and "harvest" record or other evidence of hunting WHEN YOU'RE NOT HUNTING -- is one reason why America is going into the tank. Many of us respect the hell out of game wardens, and anyone who ever has done a ride-along or other situations realizes a slice of what they have to deal with. But to capitulate gleefully when you're not engaged in any kind of hunting situation is a load of crap. If a GW walked up on the downtown sidewalk and demanded to see your hunting license and "harvest" record would you show it? If any other law enforcement just stopped you on the sidewalk, or in a store, or while you're buying groceries or dip or have the kids at the park, and demanded to see your driver's license and/or proof of residence, would you willingly hand over those to him/her?
