I am an out of state hunter that hunts land I own with other family members. Got a visit from the Game Warden (local guy plus his supervisor). I told them I didn't have my wallet on me, that it was in my truck so they asked if I owned the land or leased (I could have been a guest or a poacher, but they didn't give me those as an option). I told them I owned and they said I didn't need a license. I explained that I live out of state and not on the property and they both said "doesn't matter, if you own the property you don't need a license so we don't need to see it" and they were adament about it.
Kind of a wierd deal as they never checked my ID or for proof of ownership, but that is beside the point. Regulations say if you are an out of state resident you must have a valid non-resident license. Do these guys know something I don't?

I disagree with the law but the law says you need a license if you are out of state. I think if you own the property, you shouldnt have to have a license to hunt or fish on your own place. Sounds like maybe Mr. Warden and his supervisor feel the same way.

I don't think there have been any court cases. We had a big discussion on this a few weeks back.

I don't think there have been any court cases. We had a big discussion on this a few weeks back. Well, a guy that supervises 6 counties in SW Alabama said I didn't need one and absolutely had no interest in seeing it or my ID.

Glad they feel that way. But, I wouldn't rely on it for the future.
Expecting someone in law enforcement to know the law is asking a lot.

To the OP and any other non residents that own land in Escambia county Alabama I would call and verify the regulation on this. It really is amazing. But then again, I learned last week that cops make minimum wage. And I don�t know many constitutional scholars making that kind of money.

Game warden makes considerable more than minimal wage.
In my opinion they gave you a break, but after they read this on the internet I doubt it'll happen again.
I hate making a good first impression. There’s no way I can keep that shit up.

Go buy Lotto tickets. NOW. Why? I have a license, had proof of it on my phone (a picture of it) and it was in my wallet with my ID 50 yards away. Is it a requirement you have your ID and license on your physical person at all times? Asking cause I don't know. I do know if I had drugs in my truck they would consider those drugs to be in my possesion, so is the valid license sitting in the truck that I'm 50 yards from not in my possesion?

If I were you I would have a license like the law says. I would guess that the Game Warden is either cutting landowners some slack and not pushing that particular issue. Or maybe he was more interested in verifying other information and once you made the cut he was convinced that you are a law abiding hunter and was ready to move on.
Not real sure why he would have said that you didn't need one. But I have rarely had any police or GW run me through the ringer asking for everything they possibly could. I assume that they deal with enough hunters to have a good feel pretty quick if you are following the rules or not. Normally they ask for one thing or another then tell me to have a nice day.
