At worse, the lawyer(s) screwed up and you will get your money back, eventually. I'd make sure they knew I expected it to be with compound interest. You shouldn't be out any money and let the lawyer know he had better expedite the process and keep you informed every step of the way. I wouldn't be too nasty about it, but make sure he knows that you are willing to label it as malpractice and take the appropriate steps from there.

If you paid the property tax & can show proof you fenced & cut the grass for the last 10 years, you may have squatters rights.

If you closed through a mortgage company you may have had an Insured Closing Protection Letter. It probably cost you or the seller $25 - $35 and it will be on your Closing Disclosure or HUD-Settlement statement. That ICL (or some call it a CPL) will insure over certain things, misuse of funds is definitely one but I think it also covers lien position. Seems your problem could be covered by This. If you got a copy of commitment or policy look for the contact info for the underwriter (First American, Old Republic whoever) and call them. If there are several of you that this has happened to that person will likely be prohibited from issuing further title commitments. If you paid for the insurance SOMEONE WILL MAKE YOU WHOLE. I might recognize the closing agents name if you want to pm me.

So the two sisters inherited the land, but never filed ownership at the Probate Office, so nobody knew that legally it was theirs. What kind of proof did the brother have that he owned the land? The land/estate did or didn't go thru probate? Surely the title company had some kind of proof.

I didn't want to say this but Iam talking about 14 acres bought 5 years ago. which is still my lifes savings considering my family avereged 30k a yr. at the time. so its a pretty big deal to me even though its not 100's of k. yeah its real big.

Icl/cpl would likely only be demanded by a lender. Very unusual for a borrower/buyer to request one unfortunately.

A copy of the closing statement showing charges and to whom they were paid would really answer a lot here.

This is what I've been wondering since the first post.


Filed ownership, never heard of such. The estate goes through probate whether the deceased owner died testate or intestate. The administrator or executor of the estate, whichever the case may be, probates it. That's how it's transferred to the sisters. They can gain ownership and be in a cave 1/2 way around the world and not have to do anything themselves. They don't even have to know they have an interest in the property. That's what the title search is for, obviously the attorney didn't search very well, or more likely his assistant/secretary . However, he's on the hook for it.
