Did you get a title insurance commitment from the closing attorney at or prior to closing?

If the closing attorney is an agent of a title insurance company, and you received a commitment (and possibly even if you did not), then payment of title insurance premium as a part of closing will establish that you have a policy as a matter of law even if the premiums were never paid over to the insurance company by the lawyer who collected the money from you.

By the way, this is theft and likely a couple of other criminal issues. It is clearly a bar issue if there are multiple instances, also. Be proactive if you don't get exactly what you are asking for in a week or so.

Edited to add: if you have a title insurance commitment, go ahead and call the insurance company and make a claim immediately. They will NOT deny coverage if you received a commitment and paid premium to the attorney/agent.
