Doekiller is telling y'all malpractice. That means possible disbarment. That means Alabama BAR. Hard to get an attorney to go after another.


Malpractice isn't always a disbarment. You only get disbarred for intentional acts. If it is a mistake, it can be malpractice but not an issue for the bar to discipline someone.


That's why I said POSSIBLE disbarment.

They would definitely know my name from now on I'd be having such a fit. I bought a small tract within the last year that took a lot of wrangling to get clear title and title insurance. The last deeded owner was killed in Vietnam. No kids. It should have gone to his parents. They have since died and he was their only child. A!so, son had different last name so no one was sure if it really was his dad. It took a year or better but I bought it from someone and noboby has complained. I made sure on title insurance and what was covered.

should I not listen to the lawyer when they say they may have it all fixed by next week. if I hire a lawyer that may put a halt on any progress

Like I said, lawyers and accountants have professional liability or Errors and Ommissions insurance. File a complaint with bar and a claim against his insurance. It's his screw up as a professional. Insurance will try to defend but ultimately settle or pay right off given the circumstances. Get a lawyer in case his insurance tries to fight you

I really have a wealth of info here to look at. you guys have really opened my eyes to the situation. thanks to all"mw2015, centrala, doekiller, cattlehead, rebelman,jawbone and all others with strange screen names. Iam gonna be rereading this thread, if anyone has more to add. before this my only solutions consisted mainly of wrestling moves, like suplex, and piledrivers.

yes If insurance didn't cover it, I would go after my brother not some innocent man. I would sue my brother before I turned on an innocent stranger just out of principal. because if I took an innocent mans land, I would be no better than my brother.

they didnt tell me too much about it, except that they found a will that had the sisters getting the land. its possible the brother did own it. till this will surfaced. why didn't the sisters come forward before. I wouldn't think its right that the family sells the land and gets it for free back.

Technology does not have a lot to do with probate judges offices and deeds that are old, poorly written, and barely legible. I laugh every time I read about schools wanting to stop teaching cursive writing. Care to guess what deeds were written in before the typewriter became popular.

Did you get a title insurance commitment from the closing attorney at or prior to closing?

If the closing attorney is an agent of a title insurance company, and you received a commitment (and possibly even if you did not), then payment of title insurance premium as a part of closing will establish that you have a policy as a matter of law even if the premiums were never paid over to the insurance company by the lawyer who collected the money from you.

By the way, this is theft and likely a couple of other criminal issues. It is clearly a bar issue if there are multiple instances, also. Be proactive if you don't get exactly what you are asking for in a week or so.

Edited to add: if you have a title insurance commitment, go ahead and call the insurance company and make a claim immediately. They will NOT deny coverage if you received a commitment and paid premium to the attorney/agent.

thanks for the advice cynical. what I have is a sheet from the title company showing their fees and that I accept it and sighned it. but no owners policy. I already tried to file a claim and they ignored me.

I didn't want to say this but Iam talking about 14 acres bought 5 years ago. which is still my lifes savings considering my family avereged 30k a yr. at the time. so its a pretty big deal to me even though its not 100's of k. yeah its real big.
