I really don't think an appointment will be confirmed. There is no law that the court can't operate with less than 9. We have had occasions where the court has sat with as few as 5.
Also, I believe is there are only 8, Roberts can ask O'Conner to return to sit for the October term. I didn't think Obama Care,Common core, any of the spending nills, fill in the blank would either

A lot of people in the Nation fail to realize how important the 2nd Amendment is to all of our freedoms. Super-True words! Without the 2nd, you have no 1st, 3rd, or 4th, and without those, you don't have any of the rest of them, either. The Republicans will put up a fuss but eventually do just like they have over every other controversial issue. They'll give in and sell the country out. You can not call it a conspiracy just because its convenient for the bad guys. Folks in their 70's die everyday from strokes, heart attack, or other reasons. It is an unfortunate death for the right side regardless, and we should be thoughtful for his family and our country.
Obama will use this death to his advantage, we know this. Obama can not do anything but be what he is which is someone who hates true Freedom.
Scalia did his best to preserve True Freedom as spelled out in the Constitution. Now we must move forward and do our best to preserve and protect the Constitution from the likes of Obama even if that means we have to get ugly about it.
