This is what is going to happen: Obama will nominate a very liberal person without a heavy track record and a groups of dems will holler (all orchestrated) they are too conservative and the republicans will go right along with it and they will fly through under the guise of being a "moderate", with nothing moderate about them.
I don't see any reason he wouldn't nominate whomever he wants. The Republicans will put up a fuss but eventually do just like they have over every other controversial issue. They'll give in and sell the country out.

What it will do, is get people who weren't going to vote out to vote.

He was a great man from all I've heard and read Wanna Bet? Sure. Pre O'Connor 1981 it was a quicker process. (Which still took months) Very long drawn out process now, they spend weeks alone being interviewed by the senate judiciary committee. After the whole selection, nomination process. Then full senate approval. Maybe I'm just not the conspiracy theorist others might be, I don't think it's possible. Not for Obama, or Bush, or anyone. Checks and balances and such

They'll give in and sell the country out. He'll have some of the dems claim they are too conservative in order to quell the public outcry and allow the publicans to save face. Otherwise this would further turn voters away from the demo candidate. They don't want this to happen right now. Obama certainly doesn't care about appeasing the publicans, but his party is going to have him thinking big picture. On another note, can a president nearing the end of his term nominate himself? It wouldn't shock me if he tried and just step down early when it was time to get sworn in on the bench.
Lord, please help us get our nation straightened out.

This will be one of those situations and he'll have to use deceit because he can't "executive order" someone onto the Supreme Court (not that he won't try).

I really don't think an appointment will be confirmed. There is no law that the court can't operate with less than 9. We have had occasions where the court has sat with as few as 5.
Also, I believe is there are only 8, Roberts can ask O'Conner to return to sit for the October term.

We may be looking at this in too small a scale. Think about this; any action that obummer takes, he will have the weight of the Supreme Court behind him, any executive action he takes in favor of socialism/communism or islam will go down as law. What may have happened today could go down in history as the turning point for the U.S. and what could lead to The American Revolution part III, or the Civil War part II.

Typical process is to figure out who it will be behind closed doors then make a public spectacle of it for about 8 weeks and formally confirm them. That is how Thomas and the guy Keagle and that foreign woman got in.
