Equal protection is a nice term, but it takes understanding of what is being protected. Natural rights are to be protected per the equal protection clause of the 14th Amendment. If gay marriage is to be protected by the Equal Protection Clause, then that by default means that homosexuality/sexual identity or orientation is a protected class and a natural right with all privileges.

As of today, sexual orientation/identity is not a protected class. Although many state courts and some federal courts have ruled in ways that do give rights to homosexuals that are based on their sexuality, not their gender.

Since our Congress hasn't been able to have a Constitutional Amendment put into place on the subject, the interpretation has been left to the courts. The 14th amendment has already been trashed by interpretation enough already...ala Anchor Babies.

When you leave it up to courts to decide many social issues, eventually ideals soften, definitions change, Orwellian "new speak" happens, and you get trash decisions and precedents. Which is the resulting damage (to borrow another legal term) of the Progressive Movement deep hooks into the culture. Social justice and judicial legislation happens.

What is needed is a US Constitutional Amendment that defines marriage as one man and one woman. But I doubt this will ever happen as too many people are ball-less. Short of that, eventually all states will be forced to allow gay marriage through judicial social engineering, not following the law. I have no faith in our court system to stand firm. It may not fall this year, but it will within the next 5.

On the horizon are court decisions where sexual identity will be a fully protected class just like other recognized natural rights: race, age, religion and gender. Gay rights activists and Progressive judges will not stop until homosexuality is expressly considered a natural protected right. Make no mistake, the push for gay marriage is to further that recognition in order to make it a fully protected condition! Private business and churches will at that point have their hands full. We'd hope that common sense law application of fundamental truths would protect them, but those will change too.

I think ole Sam Adams was very wise: "Neither the wisest constitution nor the wisest laws will secure the liberty and happiness of a people whose manners are universally corrupt.

The great experiment in America worked until the decay of our culture caught up to it. When we are all old men, I doubt we will recognize our revered Federal Republic. May God have mercy on our children and grandchildren.

Marriage from a legal aspect is nothing more than a contract. Should one dude not be allowed to sell his house to another dude? Why then can he not legally give half of his stuff to another dude and sign a contract stating such?

He can. He can also go to work at places that will allow him benefits for his partner. Though that's their argument, that's not what they really want. They want to force everyone else to accept their lifestyle as normal. Unfortunately, they've got allies in the judicial system who will support them.

Marriage is what God says it is. Man can corrupt and defile it but they can't redefine what God already defined. Government chose to take control over the matter when they decided you needed a license to get married. You can twist it , turn it or spin it however you like but God will not be mocked. Man is forever trying to improve on what God has already perfected. Calling it a constitutional right won't excuse those who oppose what God has already spoken against and there will be a reckoning for it, one day. Until that time Christians are to deal with others in love and not judgement. If you can get government and God completely separated from one another dont be surprised or complain when you are living in a God less society . Homosexuality wrong and I don't like it but their souls are God's to judge just like the rest of us are subject to.

Some people want to take God's word and turn it to fit their behavior it doesnt work that way God left us a list of instructions they are located in the B I B L E in better terms Basic Instructions Before Leaving Earth everyone should read it daily and go by it , I fail God badly I am not perfect but I try to do the right thing I fight temptations all the time i am human i see these things . I feel others know that what they are doing is wrong but choose to do what they want to do to fit them not him ( God ) . I will be judged one day by all mighty God just as others will .

However, on the issue of forcing the legalizing gay marriage in Alabama I agree with him wholeheartedly. Judge Moore is honoring the law, not necessarily the US District Judge.

Moore's quote in Yellowhammer today:
Theres nothing in the US Constitution that authorizes the Supreme Court of the United States or any federal court anywhere to misinterpret the word marriage to include something outside that, Moore said recently. Whether its about the equal protection clause, the due process clause, or the full faith and credit clause, theyre making these things up and theyre ruling on social matters quote to me the Constitutional provision that gives the United States government the power to redefine marriage? You cant find it.

Our US Constitution is LIMITED in power and scope, reserving the rest of the power and decision making to the states. Alabama clearly voiced its wishes in 2006 by statewide referendum: 81% voted to define marriage as between one man and one woman.

When Federal judges step outside of their scope and authority, it takes leadership that respects the US Constitution and Alabama Constitution to stand up, stand firm, and cause trouble.

God designed marriage as one man and one woman and He alone instituted the covenant of marriage. Governments the world over have accepted this as right. With the rise of the Progressive Movement we can see their work at sanitizing things of God from our culture. Redefining marriage is simply another part of that plan.

I'll be the first to agree that "marriage" has already been dealt mighty blows and all one has to do is look at the issues of adultery, infidelity, divorce, broken homes, absent fathers and etc... Marriage for many is not sacred. But for many, including myself, the redefining of marriage to be between homosexual couples is wrong and should not be allowed.

Those without a Biblical Worldview will most likely see zero wrong with gay marriage and may even opine that "religious" talk has no place in the issue at all. I'd expect nothing else.

Our nation was founded upon Honor, Virtue and Goodness as well as Liberty. It has always been inherently understood that we have freedom and liberty to pursue those ideals that are also honorable, virtuous and good. Pursuits that are outside of those ideals have been typically without the fullness of Liberty. Example: Making money and even greed are allowable pursuits, until it crosses the threshold into wrong doing. Gay marriage is similar: People have the liberty to pursue their own sexual identity but there is nothing honorable, virtuous or good about gay marriage and it crosses the threshold into wrong doing. That's my opinion, your mileage may vary.

Agreed

That's what makes a good judge, in your opinion?

My opinion is it has nothing to do with benefits and everything to do with further separating society from Christian ideals. If it wasn't they would be happy with civil unions or partnerships and you wouldn't have some private businesses forced to cater to them against their beliefs. It's agenda driven the same way racism is , these days. They want forced embracing of their lifestyle not just acceptance.

This is nothing more than a civil union. That is all it is if two heterosexuals go to the courthouse and get a judge to marry them. But, they call it marriage too. What about common law marriage, that is legal for heterosexuals.

Again, what this opinion did was force the state to issue licenses for civil unions, the word marriage is used because it is the common vernacular.

A private business or church can not be forced to perform a gay marriage. But, they can be forced to provide the same benefits to gays and they do to others.

Let me ask you this. Where did the concept of marriage come from? Is it not in essence biblical in its origin? Does the definition of marriage biblically defined specify that it is between a man and a woman? Was marriage not originally a Christian process that was later sanctioned by governments around the world?

My point is this. Marriage from its root is a Christian practice that the federal government chose to observe. I don't really give a flying fuk what gays do.....as long as it does not affect others. That is the basis for every law in this country. You can do whatever you want as long as it does not interfere with the rights of others as defined in our constitution.

I don't care if gays have a federally recognized coupling that allows them tax benefits, etc. What I do care about is the government ruling that their rights are more important than mine. Which is exactly what is happening. Marriage is mine as a Christian. It is not the governments to define.

Marriage is not yours as a Christian. That is an ignorant, uneducated stament. Marriage existed long before Christ. By your way of thought, Jews, Muslims, Hindus or or non believers couldn't marry.

Every society on Earth practices marriage. Those 5 billion non-Christians out there practice marriage, it is a cultural universal, and marriage takes on many different forms across the entire human specie.

I disagree. God was the originator.

enesis 2:18-25 ESV /
Then the Lord God said, It is not good that the man should be alone; I will make him a helper fit for him. Now out of the ground the Lord God had formed every beast of the field and every bird of the heavens and brought them to the man to see what he would call them. And whatever the man called every living creature, that was its name. The man gave names to all livestock and to the birds of the heavens and to every beast of the field. But for Adam there was not found a helper fit for him. So the Lord God caused a deep sleep to fall upon the man, and while he slept took one of his ribs and closed up its place with flesh. And the rib that the Lord God had taken from the man he made into a woman and brought her to the man. ...

And He wil be the ultimate judge of it.

Hebrews 13:4 ESV /
Let marriage be held in honor among all, and let the marriage bed be undefiled, for God will judge the sexually immoral and adulterous.

Marriage predates Christainity. People of all religions and no religion have marriages. Marriage is NOT an exclusive Christian ideal.

Are you not just as hung up on the word "Bible"? You are correct, marriage existed before the Bible because the Bible was not completed when God preformed the first marriage, Adam and Eve,man and woman. The Bible is not one book written at one time, there are 66 separate books that make up the Bible written by 40 different authors over a span of about 1500 years. Genesis is the first book in the Bible and it starts out with "In the beginning God" then shortly describes the first marriage. Marriage is Biblical.

Am I correct that the SCOTUS is going to rule on this subject this year?

If so, then everyone involved in the pushing of gay marriage are grand standing.

Those pushing back are doing what needs to be done, delaying until the SCOTUS gives a final ruling.

I'm praying they rule for states rights. I don't give a single crap if California or any other state decides to do something as long as it's not forced on Alabama.

To each his own. I'm not gonna fight with someone over what they want to do in their home or state...as long as they don't expect me to approve, acknowledge or accept it.

Adam & Eve were pre-Christ. Lots of Jews listed as married in the OT. "Christianity" started with Jesus, therefore "marriage" existed before Christianity. That's what he means.
