11 This bill would propose an amendment to the
12 Constitution of Alabama of 1901, amending Amendment
13 597, now appearing as Section 36.02 of the Official
14 Recompilation of the Constitution of Alabama of
15 1901, as amended, to clarify that the people have a
16 right to hunt, fish, and harvest wildlife subject
17 to reasonable regulations that promote conservation
18 and management of fish and wildlife and preserve
19 the future of hunting and fishing.

26 Alabama of 1901, amending Amendment 597, now appearing as

1 Constitution of Alabama of 1901, as amended, to clarify that
2 the people have the right to hunt, fish, and harvest wildlife
3 subject to reasonable regulations that promote conservation
4 and management of fish and wildlife and preserve the future of
5 hunting and fishing.
6 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
7 Section 1. The following amendment to the
8 Constitution of Alabama of 1901, as amended, is proposed and
9 shall become valid as a part thereof when approved by a
10 majority of the qualified electors voting thereon and in
11 accordance with Sections 284, 285, and 287 of the Constitution
12 of Alabama of 1901, as amended:
13 PROPOSED AMENDMENT
14 "Amendment 597.
15 "(a) All persons shall have the right to hunt and
16 fish in this state in accordance with law and regulations.
The
17 people have a right to hunt, fish, and harvest wildlife,
18 including by the use of traditional methods, subject to
19 reasonable regulations, to promote wildlife conservation and
20 management, and to preserve the future of hunting and fishing.
21 Public hunting and fishing shall be the preferred means of
22 managing and controlling wildlife. This amendment shall not be
23 construed to modify any provision of law relating to eminent
24 domain, trespass, or property rights.

25 "(b) This amendment shall be known as the
26 "Sportsperson's Bill of Rights.""

1 Section 2. An election upon the proposed amendment
2 shall be held in accordance with Sections 284 and 285 of the
3 Constitution of Alabama of 1901, now appearing as Sections 284
4 and 285 of the Official Recompilation of the Constitution of
5 Alabama of 1901, as amended, and the election laws of this
6 state.
7 Section 3. The appropriate election official shall
8 assign a ballot number for the proposed constitutional
9 amendment on the election ballot and shall set forth the
10 following description of the substance or subject matter of
11 the proposed constitutional amendment:
12 "Proposing an amendment to the Constitution of
13 Alabama of 1901, to amend Amendment 597, now appearing as
14 Section 36.02 of the Official Recompilation of the
15 Constitution of Alabama of 1901, as amended, to clarify that
16 the people have the right to hunt, fish, and harvest wildlife

This is being pushed because of your incessant badgering and pestering. If it passes we will have fewer hunting and fishing rights and the DCNR will have more regulatory power. It really is the anti-49er bill.

If it's not clarified that the DCNR cannot reduce bag limits on deer by 98 percent for wildlife management purposes, then they will be left to reduce the bag limits to zero if they choose.

They have already considered a bag limit of 1 buck per season.

Sasquatch, it means we have the right to hunt and fish wildlife as long as we do it in a way that promotes conservation of said wildlife.........so if some scientists say there are no fish left in the sea and no deer left in the woods, we can't hunt or fish.

Guys I think we are missing the point here.
The first part of the bill is just rewording/defining this:

All persons shall have the right to hunt and
fish in this state in accordance with law and regulations.

The right to hunt has always been in accordance with regulations so how is this bill changing that? It is not giving DCNR any more rights than they already had.

The main part of the bill and intention of this amendment is this;

Public hunting and fishing shall be the preferred means of
managing and controlling wildlife. This amendment shall not be
construed to modify any provision of law relating to eminent
domain, trespass, or property rights.

So that when currently un-hunted lands in this state get overrun by game(deer in particular) we the hunters get to take part in thinning the heard instead of hired snipers.

I am in no way for more government but don't really see where this is anything but positive for us hopefully opening up some more public access to hunt. Like that at Oak Mountain.

There seems to be some confusion here.

The current law already reads Under existing law, "the Constitution of Alabama of 1901 provides that all persons have the right to hunt and fish."

This proposed change alters that and leaves it open to interpretation by whoever happens to be in charge at the time.

These can be tricky and difficult to understand. After reviewing, I was thinking along the same lines as ABC bh. Endorsement by the NRA makes sense to me.

We need some concesus here, so everyone is confident about these amendments.

If I understand 49ers post correctly, wouldn't the insurance companies prevent that from happening?

I know they spend a lot on lobbying for more hunting.
