I was down at our timber farm today and found survey ribbon down a road that is along one of our borders. The neighboring property owner is a surveyor and says he knows nothing about it. I realize common courtesy is now uncommon, but shouldn’t someone have made an effort to let us know about being on the land? The best we can guess is another nearby owner is getting ready to cut some timber and plans to use the road to get the logs out. Am I required by law to allow him access? If this is true, should he not have reached out before having the road flagged?

How large is your timber farm? Is the road and/or flagging on your property? What color is the flagging?

425 acres. The road is on our property, confirmed by the surveyor this evening. The flagging is orange.

Check the tax map and see if there is deader easement. I have ran into a deal called presumptive easement, which was a little more tricky.

Maybe I’m missing something, why not play nice and let them get the timber out with the understanding the road should be in as good or better shape?
You could probably talk the loggers into cutting you a food plot or two

I’d prefer to play nice. I’ve let them use a spot for staging trailers, even though they never asked. I can work something out for using the road, but I’d be in a lot better frame of mind to do so if they would ask about it now instead of when they are ready to start cutting. As far as asking them, right now, I don’t know who “them” is.

May or may not be specifically described in your warranty deed (they often use language such as “subject to any and all” etc). You want to read your title opinion.

Make them bond the road or tell them to push their own road or find other access. No way I’d let anyone on my roads without it being bonded. If not you’ll be fighting with them in court over the damages and repairs.

As far as asking them, right now, I don’t know who “them” is. Where does the road lead? Who are your neighbors? It should be pretty easy to figure out with an aerial tax map. Until then, keep your gate locked.

Do loggers put survey ribbon on roads. If they flagged this to guide trucks, where is the last ribbon?? Do the markings lead to someone else's property?
