You can charge a hunter with both trespass and hunting w/o permission for the same offense. Done it, convicted on both.
I've spent most of the money I've made in my lifetime on hunting and fishing. The rest I just wasted.....

You can charge a hunter with both trespass and hunting w/o permission for the same offense. Done it, convicted on both. Absolutely, two seperate crimes. You can trespass and not be hunting and you can also be hunting w/o permission and not be trespassing.

I agree if you can prosecute and have a good case you need to do it in these circumstances, JMO.

The sun was rising behind the camera and caused a glare I had to edit it just to make it halfway clear. Well unfortunately the decision to prosecute is my dads and he doesnt want to fool with it. If it was up to me I would. It was a kid and he looked pretty scared but I know he will forget about the scolding in a week or so.

If the game warden is involved there nobody has to prosecute. They get a ticket for hunting without permission. If you call the sherrif, you have to prosecute.

Don't know about the rest of the state, but in the foreign country known as Sumter County, the minimum fines and jail time are whatever Judge Montgomery wants them to be. I caught a friend poaching during turkey season a few yrs back. He promised he wouldn't be back. A few weeks later he was back. He had a well deserved reputation for poaching. So I decided to prosecute. Of course, he was furious. Supposedly, he continued poaching on my lease throughout the remainder of the season. So a year goes by and we are near trial date when the game warden catches him hunting on us again. He even gets video of it. Rumor has it that he had nearly 20 prior game violation convictions. What does the judge slam him with??? $25. Seriously, $25. There were three of us splitting the cost of that $8000 lease. And he got to hunt it more than we did for $25. I dropped the lease after that.

Here's what I've done. I'd tell them to go make a donation to Hospice in memory of a relative, $100-$200 depending on my mood and I won't prosecute. I'd tell them next time they get to see Judge Grider, no donation. Hospice loved me! Everyone did the donation exept one. I swore out a warrant and the GW delivered it. GW asked him why he didn't do the donation. He said a lawyer told him not to, GW told him he got some bad legal advice. Cost him more than $200.  I never caught a repeat offender.

We have the opposite in Jackson Co. Judge Grider causes poachers,roadhunters and spotlighters pain. He just fined a roadhunter that shot a small buck $3500. Now that's one expensive scrub buck! in the late 60's Sumpter had the toughest judge in Alabama, Judge Seale. Nighthunting usually ran around $50, maybe $100 everywhere else. Seale charged $500, second time ya did time at the Sumpter Hilton....

I think the problem with kids poaching is that alot of times they come from families with little money and therefore cant afford property to hunt on ,I wish I had enough property to sustain a youth only club .Poaching is wrong by all means ,however if it is a kid how harsh should you be ,maybe even offer a compromise ,kinda like work for hunt

The boy poaching in the picture above owns the fifty acre property next to our land, and could just as easily hunt on his property. We spend months preparing and planting our food plots to benefit the wildlife, he has figured out that they can just let us do all the work and then just wait till were not hunting and come shoot all the deer using them, they plant nothing and shoot everything. I'm not trying to be mean but this is exactly the problem, people making excuses for criminals. There is an 11,000 acre WMA ten minutes from our property that is full of deer, and other people plant the greenfields for them there too.
