So my wife was in Montgomery driving my truck. I picked up certified mail from the post office from the city of Montgomery. Sure enough it APPEARS in the picture that she ran the redlight. I don't know if she ran the redlight but I'm gonna ask. Not typical of her. I know it's been discussed before. What's the consensus on redlight cameras in Montgomery?

You can watch the video and see if she ran it or not. That is pretty clear cut. What isn't clear cut is if they are just an attempt at an end run around Alabama Criminal procedures. Well actually, I guess it is pretty clear that they are, which brings their legality into question.

They are unconstitutional and illegal. Its government sanctioned extortion. A violation of several rights.

Buddy of mine is a prosecutor for the City of Montgomery. I called him when my son got one. He said if it's not paid the city will eventually turn it over to collections. You can go online and watch video of the alleged infraction. I watched the video, saw that he was close but did run the light, and reluctantly sent a check in. Those cameras are in a lot of intersections in town. They claim they have cut down accidents where they are installed, but who knows. The city only gets a portion of the fine, I believe the majority goes to the company that installed and maintain the cameras.

The money collected is split amongst state,city and owner of the cameras. Cities usually lease which is much cheaper by allowing the camera owner to collect a small percentage of the PAID fines.
They are legal by the state of Alabama where they are installed. Bottom line is if you got a ticket then you did in fact run the light. Sounds like a lot of people are not sorry they ran a light and could have killed somebody. They are just sorry they got caught.

They are not a moving violation, they cannot prove who was driving. They are the same as a parking ticket, no points towards your record.

It's a cluster, basically trying to enforce a civil violation in criminal court I believe. Is the ticket signed by an officer saying he/she witnessed your wife running the red light?

100 % approve of the cameras, if you drive by the laws you dont have to worry about the cameras, way to many people dont obey the laws.

If you want to fight it, you can ultimately win. there are all kinds of potential constitutional problems with the citation. But, even putting that aside, the government still bears the burden of proof, which is generally hard to meet in these cases. Realistically, you may lose in municipal court; however, pretty good chance of winning on appeal (you basically get a new trial in Circuit Court). Obviously, all of this takes time and some money, if you want to hire a lawyer (which you would probably want to do if you are raising the constitutional issues. I fought one and won in Selma that I got when either my wife or daughter was driving (they both blamed the other, but since I owned the car, I got the citation). I spent more time on it than i would have liked, but since i'm a lawyer they realized quickly that I was right and they didn't want to fight it.

100% disapprove of the cameras. If the city wants to sit it and patrol and write a legal ticket, then they should.

At my previous company we had a mailbox we did not use and i didn't even know existed when i took over because we used a p.o. box. Probably a year later i was notified about the mailbox because it was knocked down. I went to check it out and found multiple "tickets" from the vaughn road/ray thorington road red light camera. It has pictures of our box trucks going through there. I found the initial tickets and then several warnings/final notices etc. I acted like i never saw them and nothing ever happened. I was able to renew tags and everything.

Those cameras are a joke. Half the time i would be waiting at that light it would just randomly flash when no one was even going through the intersection. Now if you did get it certified that would at least worry me a little. None of mine were certified.

This person was ticketed in Montgomery and got it dismissed.
