It will be hard to get your money back but of course they have to fix if it’s under warranty. I think it’s basically in their discretion to fix it or give you a new one, to an extent. If you want a new one it’s possible but if they don’t want to replace it you’ll have to put up a fight. If it’s a really bad defect then you might be able to get your money back but you’re probably going to have to sue them.

Hate to break it to you but I've been there, done that. The Lemon Laws are not on your side. It takes a LOT to actually get it replaced through Lemon Law, and as a lawyer told me once, when I was exploring this avenue. You'll end up spending more in legal fees than you would if you traded/sold it and took the the loss on depreciation. I can't quote the specifics, because it's been a long time since my experience, but it's something like they have "x" number of times to fix the same issue before you can start the Lemon Law process. Then, after the process is started, they still get something like one or two more times. I know someone will tell me how wrong I am but it's been 12 years since I went through this and I know I've forgotten all the legal advice I received. I bought a new F-150 back in 2006 that was a Lemon. I owned it 1 year. In 1 year, it was in the shop 11 times. Once for a whole month. It was for issues such as, a/c went out, transmission problem, brake problem, stuck valve, had a head replaced, electrical shorts (multiple), etc... Lemon Law wouldn't cover it and the dealership and Ford wouldn't do anything for me.
Best thing to do, is to remain calm and try to deal with the dealership if Polaris won't do anything for you. Good luck.

I’ve had to deal with lemon law once on a 98 Dodge Ram. Had it less than a year and it spent 6 months in the shop. I had a relatively easy process. I dealt with a district manager from dodge and we went back and forth a few times but we eventually agreed on a number and I got rid of the biggest POS I’ve ever had. Worked out really well for me in the end. Hopefully the OP can get his situation resolved as easy as I did.

For the lemon law it is usually 3 attempts to repair the problem unless it is something very serious like the brakes. I went thru it with a 2001 gmc, at the second oil change it had been aligned 4 times. Gmc tried to blame the roads. Document everything and find out if it is a common problem with your vehicle. Precedent is big in arbitration. I went thru the bbb.

Meh FNLs brother purchased one last (His cousin has one also) week, and he's ready to trade it in on a Polaris like we have. #1 You'll bake like a potato in that hot sumbitch #2 It sounds like a yugo when it shifts through the gears lol....And I've spent more money on repairs to my yota than my last 3 vehicles combined. Twice I've had to have the bearing, seals, and brakes replaced on my rear (first driver then passenger) because gear oil totally destroys your brake components. Not too mention the drive shaft, and now it has the dreaded shudder in the trans just great......Sorry Fellers all brands/Manufacturers have their Lemons...For the OP, I hope u get it taken care of, I know i would be pissed......
