Can you do it? Do you need a permit? Friend of mine had a big tree fall in a backyard, we got it all cut up and moved except for the last 5 feet of the trunk and the stump. We are thinking about burning it?

To be safe, call the local fire department and ask about a burning permit. They will direct you to the correct agency.I got in trouble one time for not having one. Long story, but now I call before striking a match!

The Alabama Forestry Commission issues burn permits under certain condititons:

Burn permits - AFC

I was told when I volunteered at our fire department that ADEM restricts burning during the summer months due to air quality restrictions. A statement in the following article fits what I was told:

To assist in meeting regional air quality standards the Alabama Department of Environmental Management (ADEM) implements summer open burning bans from May 1st thru October 31st in twelve Alabama counties: Baldwin, DeKalb, Etowah, Jefferson, Lawrence, Madison, Mobile, Montgomery, Morgan, Shelby, Russell and Talladega Counties.
What is banned? The open burning of untreated wood from construction or demolition and the open burning of vegetation from clearing or maintaining non-agricultural property. "Prescribed burning of agricultural or forestlands for silvicultural, agricultural or wildlife management purposes is allowed under the AFC Burn Permits for these counties." Note: Jefferson County bans agricultural burning during these 6 months.

Jefferson county is VERY strict on burning. You need a permit from the Health Dept. There is a loophole that says you can have a small "cooking" fire, so if you have a burn barrel and some hotdogs, you might have an argument.

The air quality thing may have been lifted. But the state also bans burning during times of the year because of the danger of it spreading and getting out of control.

Your local Fire Chief can update you on the rules and assist with getting a permit if possible.

5.1 Open Burning.
5.1.1 No person shall ignite, cause to be ignited, permit to be ignited, or maintain any open fire except as follows:
(a) The following which require no written authorization from the Health Officer or advance notification to the Health Officer:
(1) Open fires for the cooking of food for human consumption on other than commercial premises;
(2) Fires to abate a fire hazard, providing the hazard is so declared by the fire department or fire district having jurisdiction;
(3) Fires set in salamanders or other devices used by individuals for heating purposes, provided that warming fires are contained in a noncombustible container, and further provided that materials burned are clean wood, or fuel appropriate to the heating device.
(b) The following which require written notification to the Health Officer prior to the event:
(1) Fires for recreational or ceremonial purposes;
(2) Fires for training personnel in the methods of fighting fires. Written notification shall be made at least 10 days prior to the exercise. If the exercise includes demolition of a structure, the demolition shall comply with Section 14.2.12 of these regulations;
(c) The following which require written authorization from the Health Officer prior to the event :
(1) Fires for recognized agricultural, silvicultural, range and wildlife management practices;
(2) Fires for prevention or control of disease or pests, where no other practical or effective method of control is available;
(3) Fires for disposing of vegetation grown on that tract of land provided that no written authorizations shall be issued during the months of May, June, July, August and September of each year. (See section 5.1.2 of part 5.1).
(4) Any other open fires specifically or expressly approved by the Health Officer.
5.1.2 Open burning shall be prohibited during May, June, July, August, September, and October of each year, except as allowed or authorized under the following subparagraphs of Part 5.1., Subparagraph 5.1.1(a)(1), (a)(2), (b)(1), (c)(2), and (c)(4).
5.1.3 The open burning of materials other than vegetation or untreated wood, except as otherwise provided for in these regulations, is at all times prohibited.
5.1.4 Anyone igniting or maintaining an open fire allowed or authorized under the conditions above is responsible for compliance with any other fire control regulations, to include the obtaining of permits or permission from local fire jurisdictions and the Alabama Forestry Commission.
5.1.5 Open burning under section 5.1.1 of Part 5.1 shall be done in compliance with the Department’s written “Guidelines and Standard Operating Procedures for Issuance of Open Burning Authorizations,” as the same may be amended or revised. This document is incorporated by reference into Part 5.1.
5.1.6 No open burning shall be allowed or authorized during any stage of an air pollution episode, as defined in Chapter 4 of these regulations. All open burning shall be extinguished upon the declaration of an air pollution episode watch, alert, warning, or emergency by the Health Officer. No open burning shall resume until the full termination of all episode stages.
5.1.7 Open burning within any particulate matter non-attainment area, including any past or current designated non-attainment area, shall require the use of the air curtain incinerator (trench burner) method, or equivalent, as specified by the written authorization issued for such open burning.

Jefferson County Department of Health regulations

1.14 Penalties. (Revised May 8, 1991; January 10, 1996).
1.14.1 Any person who violates any provision of these regulations or who violates any determination or order of the Health Officer pursuant to these regulations shall be liable to a penalty not to exceed $25,000 for said violation and an additional penalty not to exceed $25,000 for each day during which such violation continues, which penalty may be recovered by the Jefferson County Board of Health in a civil action in the Circuit Court of said county and such person may also be enjoined from continuing such violation.

Growing up in south JeffCo we had a burn pile going all the time. On five acres there was always something that needed to be burned. I don't ever remember there being a problem with it, other than the occasional "no burn" days when drought was going on.

My 5 in Shelby fits that to a T. Always a pile of something needing burning. And I do when it's not too dry. Since I'm in the country nobody cares. In Vestavia we get a burn complaint every time someone lights a cigarette or tries to grill.

Jefferson county, along with several more counties are under a no burn from May 1st til Oct. 31 every year. They have loosened this a little but in the past there was to be no burning at all (except for small camp fires and for cooking). Now they have given local chiefs in the vfd's a little leeway. You need to contact them before you do. Or just wait till after Oct 31st, dont need a permit from forestry if under a quarter acre. If you are in the city limits it a whole nother ball game.
