Sunday afternoon I rode down to a small tract I have had for about 10 years. It has an Indian Mound on it that trespassers love to dig in. I was walking to my tree and find a man hiding behind a tree trying to avoid being seen. I walked to him and asked him if he had permission to be there and he said he was only digging arrowheads. I immediately called the landowner who happens to be my wife's business partner and she said she was calling the sheriff. Deputy arrives and questions the crackhead for a few minutes and basically tells me he has to just let him go! You have to be kidding me! He's been digging in a burial mound and trespassing on property that is plainly marked for no trespassing. He has no weapon, so no hunting without permission can be filed. I did not see him digging the mound so no charges can be filed for this either. The shovel he is carrying has black dirt from the mound all over it. There is no way he could hide his digging. Deputy asked him how he got here and he tells him he was dropped off from the highway by a friend and he was walking the creek looking for arrowheads. Deputy tells him to hit the highway and don't come back or he will be arrested....

Talk about having your bubble busted! This is the second one I have caught on this tract. It got so bad two years ago they would come in at night and build fires to dig the mound. They would leave human bones where they were digging, but I have never seen a skull they have left behind. I assume they take the skulls with them. It simply is an understatement to say the crackheads have more rights than we have. If you don't stomp em when you catch em, they just simply walk away with a hand slap. Rant over.

I can't stand a thief.

The landowner can sign a warrant if they wish.

I'd be calling the high sheriff.

If she has her property lines marked and/or fenced along with no trespassing signs posted , she should go give the high Sheriff a tune up.

Sounds like the deputy didn't want to do the paperwork.

Seems to me that if the law was broken there has to consequences if charges want to be pressed...

They who can give up essential liberty to obtain a little temporary safety, deserve neither liberty nor safety.

She told the deputy personally she wanted charges filed. Nothing we could do. He simply walked away.

Yup, pretty much the norm for piddlers. A warning and let go. Ive been thru it many times. I used to feel sorry for some of them but now i dont. I cant tell ya how many cars Ive had towed and impounded.
The last one showed up just a cussing me for having his van towed and costing him $200 to get it. I asked him if he would have fixed my gate his van was sitting stuck on when he tried to run thru it.
Make sure you get a report from the LEO showing the persons name etc. so you have documentation they were warned off. I was told by a judge that it wouldnt stand in court unless was in writing from the first time.

If you will go testify , she may get a warrant for his arrest if the DA will play ball.

Exactly what it was. His supervisor needs to know about this. Sometimes you get lazy ass officers that will spend more energy talking someone out of doing a report instead of just doing one. They were Trespassing and she is well within her rights to sign a warrant if she wants to, assuming someone has his info at this point.
