Because we live in a country where people are innocent until proven guilty. Just because the police say someone is guilty or arrest someone doesn’t mean they are. Every person is entitled under our constitution to a defense and a trial if they want it. If they are guilty, the. They will plead guilty or be convicted and most likely get the death penalty.

He did before they charged him with the kidnapping and murder. At that point they didn’t have enough evidence to charge him. He was arrested again today and will be held without bail.

The parents had to be the ones that gave the weight to the police. The fact that they didn't have a clue about how much their daughter weighed is very telling to me. I mean, it isn't even close. Some dumb sheriff or cop should have said that there is no way that this child was 60 or 70 lbs. This is just a sad situation with too much stupid and too much evil involved.

My heart goes out to the family of this baby. No one, especially a child, should ever experience what this on did. Hope God lets her sleep peacefully tonight.

Ill be interested to see what comes out in the next few days, from what ive been hearing they let her go to a party but no one at the party remembers her being there, the party was at night in an apartment complex parking lot supposedly. The dad set up a go fund me the very next day to cover "expenses" even though there were none. and numerous other things. everything about this case and parents seems fishy. their either in on it or the most negligent parents ive ever seen

Because I've done it before, you have to say "Outstanding Job" to the investigator/Officer or whoever it was that got the description of the vehicle from the child witness that was detailed enough to give identifying information that led to them finding the vehicle which was probably the first big break in the case.

If y'all will indulge me for a minute, I will tell you of a similar case I had. When I was a rookie we responded to a call of a child being raped behind a store. The detective at that time, Al Krunosky, worked it and got a confession from James Henry Bibby. He was sentenced to ten years but didn't do the full ten. Al moved on a few years later and I took his job working child victimization cases. One Saturday morning I was called out on a child being kidnapped from a grocery store by her house. She was led away with the promise of a few dollars if she helped wash his car (like a 4 year old will be a lot of help). Anyways the 5 year with her didn't go. I interviewed her and she described the car as old and had a streak down the side. She was adamant that the guy had snakes on his feet. Now that was a puzzler to me, but I recorder her saying it and noted it in my notes even though I had no idea of the relevance at that time. I put out a BOLO for an old car with a streak down its side, again not really knowing the relevance of that. In the meantime the child came home, roughed up and torn vaginally, but alive. We all went to the hospital and she was treated and before I could get home Sgt. Anita Barlow saw an old car covered in primer but with a streak painted down its side as if they were testing a color. She stopped it and called me and I immediately went to the scene. The driver was James Henry Bibby and when we got him out of the car, guess what he was wearing? Some pretty Snake skin boots. Long story shorter, we had him on camera in the store, and the other child IDed him and the car, so we arrested him. His seman was later positively IDed from the Rape kit. He had been released exactly one year to the day for the first Rape when he committed this one. He refused to give a statement and I got a Search Warrant for his house. One of the things I found and seized was his "Diploma" for completing Alabama's Sexual Offender's program. Bibby surprised us all on his first appearance in Circuit court and told the judge he was guilty (A Blind Plea). Judge Meigs looked a little confused and Bibby's lawyer, Billy Faile, a good lawyer and former DA shrugged his shoulders and told the judge that he advised otherwise. Judge Meigs said "Well, OK, I sentence you to Life." About 5 years later Bibby wrote me a letter asking if he could have his boots back? I turned that over to the DA and he said, "No, as long as he is in prison, there could be a chance at an appeal, so we'll keep the evidence".
As both the times he got caught he was a little more brutal we knew that eventually, probably his next one, he will kill the child. I'm prepared, as long as I live, to testify before the Parole Board as to the pattern of him becoming more violent in his efforts to prevent the little girls from being able to ID him. Last I looked, he was still in prison and hadn't been up for Parole yet. I seriously doubt they will ever let him out. I'm just thankful that that little girl that they called Pudding, didn't end up like cupcake.

This memory prompted me to check up on Mr. Bibby. I am confident that he will never see free daylight again even though he is eligible for parole in 2024.

Horrible, absolutely horrible and I can't imagine a worse nightmare for both that child and her parents.

For me, there are a lot of unanswered questions about the parents. Did they owe a debt to someone? Did they want party money and sold her? I believe the parents are, at the least, criminally negligent in this situation. I hope everyone found guilty of anything in this case gets life or the death penalty. I would like for them to suffer some too.

I was with the BPD and BFD assisting in a search and there is a lot more to the story not being told publicly. I see a lot of things but it's really heartbreaking when a child is involved. It's a shame what little value people have for other peoples' lives.

It is very, very rare for a child to be abducted by a stranger. If she was molested, as I suspect she was, it is even rarer to have a stranger be the offender. It happens occasionally, but you may be right that there is a family connection the police haven't found yet. That would not surprise me at all, but then again, nothing about cases like this can surprise me.

My secretary, who once lived in Tom Brown Village when she was younger, has raised the same issues with me. The first thing she said was, who has a kid’s birthday party at 8? The issue with the dad and the go fund me is really weird.

In the back of my mind, I have this idea that whoever took her out the body where it was found because it was close to the apartment where the first suspect (the guy the have charged) lived. If it was the “dad” (I’ve heard he isn’t actually the father), putting the body there would sure get suspicion off you.

If the "dad" is somehow involved, they should fry him til his eyeballs pop.

Absolutely. If they both participated in the kidnapping and murder. I’ve been involved in cases where there were as many as 6 people charged and convicted/plead guilty in the same murder.

However, I agree with Jawbone. I would bet the female agrees to tell everything she knows and testify against the male and ends up with a plea to murder and/or kidnapping with a 20-30 year sentence.

AL law has minimum sentence at 10 years in first degree rape and sexual torture. Rape especially of younger children is by far the most detrimental to our long term existence as a society. The victims never fully recover and it snowballs overtime into hearing about this kind of thing every other week and I'm sick of it! What can they do to fix this in AL? The dang chemical castration bs aint worth a dang if its not permanent and can even be reversed! I hate if for little Cupcake and i have followed her story from the beginning and prayed for that baby every single day, I've got young daughters about her age myself so this news really hit hard. My mind has wondered into some dark places since i heard the news last night, the guy having kiddy porn on his phone and the women being charged with kidnapping previously, the car with the same exact make model and color, it was all right there and lined up perfectly, i think they let him bond out just so they could keep him under 24 hour surveillance in hopes he would lead them to her. With the dudes pending charges when he was released it hurts me to imagine what that baby went through before she was killed. Then to just toss her away like she was nothing, like she was just a bag of garbage just burns me even more. If you search the “native” part of facebook, you’ll find where supposedly he robbed a drug dealer. That drug dealer gave him an ultimatum, saying he had better pay him back or he’d never see his daughter again. IF THATS TRUE, this little girl is right where she needs to be. In God’s arms and not with that “family”.

The news tonight said this was the 2nd kidnapping case that woman was involved in. I pray that the other prisoners take these 2 out real soon after they're incarcerated.

I believe I would have been slow to react as a deputy in the video. Might have had to go on break. I mean what parent doesn't look after their kids? I was somewhere close by to mine all the time, never out of eyesight.
