I hope they find her. At least give family some sort of closure.

The consensus seems to be that she lied and claimed to be the driver to cover for her impaired husband. I’m no expert, but I would certainly think False Reporting would be a more appropriate charge but the next boating accident I investigate will be my first. I’ve certainly dealt with this in vehicle crashes and the DA always wanted to go with False Reporting so I’m still curious about all of it.

I would guess it's another chess match. The DA knows the man was driving. Maybe can't prove it. Maybe can. But when the DA starts plea negotiations with the man, the man knowing his wife is facing jail time for what he did, will be more agreeable to the DAs offers. If the man takes responsibility, they will reduce the wives charges to false reporting. Just my thoughts.

Sounds plausible centralala. The thing I still cannot figure out from all the articles is: were both boats underway when the collision occurred? I do not see anything in any of them stating that the pontoon boat hit the ski boat sitting still. It is a tragic accident all the way around, made even more so, by the fact that the poor girl's body has not or may not be recoverable. Most likely avoidable had all parties involved not been BUI. Just tragic.

Pontoon was under power with the ski boat sitting still. I was told both had lights on. No reason for the collision.

Interesting. Man and wife can't be compelled to testify against one another, can they?

And I really wish they had already found the missing woman. Hopefully she will eventually be found. The family needs and deserves closure.

I firmly believe that a double gallows should be constructed on the East Lawn of The White House. Politicians who willfully and shamelessly violate their oath to uphold and defend the Constitution of the United States of America should be swiftly tried and, upon conviction, publicly hanged at sunup the day after conviction. If multiple convicts are to be hanged they can choose with whom to share the gallows or names shall be drawn from the hangman's hat to be hanged 2 at a time.

How can you be responsible for hitting an unlit boat at night, assuming you weren’t doing anything else illegal? Sounds like the husband/wife team called their lawyer before the statement. They’ve fabricated a perfect story. Again, assuming all I’ve read in this thread is true 😂

not sure what the best way to handle them is but they shouldnt be on tv and gettn married and raisin kids

I've seen this story on the Birmingham news stations a lot, as well as the Huntsville stations. I don't know any particulars, except that the Fite kid was involved somehow. I'm sure her family is working to keep this story in the news cycle.

Sad situation, and just shows how drinking and boating are a bad idea, especially at night.

That is a plausible theory, but not a strategy I agree with particularly. I never was a big fan of the "OK, tell me whose dope this is or everyone in the car goes to jail". FWIW, our DA didn't like this either.

Is the Fite kid related to Fite Construction in Decatur?

Perhaps that is the answer to why both were charged, but then both would have 5th Amendment rights to not say anything so that isn't the answer.

I’ll be shocked if they find her body. The area where the accident occurred has depths of 200’+. In addition that area DID NOT have the timber removed prior to the lake filling up. It’s a virtual underwater forest. My brother (former task force rescue diver) has been in on several searches and said it’s almost impossible to find anything. Due to low oxygen levels at those depths some trees even have leafs still attached.

It’s a bad situation all around and like others I wish the family could find closure.

Ant or Doekiller,

How does contributory negligence, if it does at all, play out in criminal cases in Alabama? Is it similar to our civil/personal injury case law? I'm pretty familiar with this on civil construction litigation or premises liability claims, but not sure on criminal cases. Just curious.

Prayers for the family and loved ones. Hopefully the full truth is revealed and appropriate justice is able to be served.

Mike

Werent both parties BUI? If so, on water, without witnesses, how do they prove whose at fault? Words of two drunken parties?

Im hopeful they will find her body so the family has closure. Sad situation all the way around
