So a little while back I put a ruger m77 mkII on lay away at Larrys in Huntsville. I put $100 down on it. I’m a m77 freak but have since come across a better deal for my collection.. I’ll only hunt with the one my dad gave me when I was 7 or 8 but love collecting them. Anyways, this one is stainless or nickeled and has a synthetic stock, not the skeleton stock just a normal synthetic one. I’ll be out $100 but the deal I came across will make up for it. It’s used, in great condition and chambered in 300 win mag. I’m really busy but maybe if someone wants one and wants to save $100 clams we can meet at Larrys and I’ll pay them the remainder of the balance with your cash. I think it’s $717 left. I have the receipt of the balance in my wallet. If someone’s interested let me know.

Just make the purchase and sell it if you want, but don't even mention buying it for someone else. They getting crazy about the straw purchase clause.

I had an idiot give me words once when I was showing one of those Cricket rifles to my 6 year old boy. He said something to the effect that I couldn't buy it for my son,and I just left. It was a big box store somewhere. I decided to go to a gun shop where they had some sense.

Even so if I was going to do that deal I would just have my buddy come in and out with me while I bought a gun.

Same thing happened to my cousin. He was 22 or so and wanted a .22. They all went to dicks sporting goods and wanted to buy a gsg mp5. Guy at the counter said that’s a weird choice for a man and my uncle said no, this is for my son. Clerk refused to sell it to him so he went and got cash, gave it to his son so he could buy it himself

I think they should rewrite the law to say exactly what I think the spirit of it is after. It should simply say that you can'y buy a gun intending to give or sell it to anyone legally unable to own a gun. I'm sure though that when they wrote it they didn't think folks would bother not to sell to the tattooed guy who can't speak English so they just threw a blanket that covered anybody.

Can't the person who will own the gun just fill out the paper work and then it doesn't matter who lays out the money for it?

Yes it does matter, matters up to 10 years and $10,000.00 fine.

https://en.wikipedia.org/wiki/Straw_purchase

In the United States, a straw purchaser of a firearm at a federally licensed firearm dealership who lies about the identity of the ultimate possessor of the gun can be charged with making false statements on a federal Firearms Transaction Record. If a firearm is purchased as a gift, the transaction is not a straw purchase, and the person buying the gift is considered the end user. It is illegal for any person not in possession of a Federal Firearms License to purchase a firearm with the intention of resale except for private purchases in lawful sales made outside of federally regulated dealerships are not subject to such rules and are legal unless the gun is used in a crime with the prior knowledge of the straw purchaser.

Dang. Whatever happened to the gun for Christmas?
Straw purchase I guess.

No, That's not a straw purchase. That's why I was ticked off when the young guy said what he did to me. It would only be illegal if I was buying it and selling it to someone,or buying if for them because they can't legally buy it.

It's perfectly legal for me to buy one and give it to someone,as long as I don't know they are dangerous or I am not doing it because they couldn't otherwise legally own a gun.

It's perfectly fine for me to buy a Cricket for my son and for anyone to know I am buying it for him. In such a case I can answer truthfully that I am the buyer-purchaser of the gun,as stated by the BATF.

While we are on it,it's not really legal for me to buy a gun on a good deal intending to sell it later. The BATF doesn't really try to go after you though unless they see a pattern of someone doing it enough to be operating as a dealer under the radar without a license.

i thought there was something in there that said you could do that as long as at the time you are buying it,you are buying it for yourself and later decided to re sale or trade it. I cant remember the exact vernacular. Its something like "to improve your collection" or something.

Yea,I remember some such. Point is that you can buy and trade and sell as a hobby but you aren't supposed to be acting just like a FFL dealer without having an FFL. Technically ,you aren't suppose to ever buy a gun with the sole intention of selling it unless you hold an FFL.

From the ATF guidelines -

David enjoys hunting and has a large variety of hunting rifles. He likes to have the newest models with the most current features. To pay for his new rifles, a few times a
year David sells his older weapons to fellow hunters for a profit. David does not need to be licensed because he is engaging in occasional sales for enhancement of his
personal collection.

Always buy and sell with the intention of enhancing your personal collection, not to make a profit.
