I'm going to have to be very vague here with locations and such because as far as I know some of the legal stuff is still going on, though close to coming to an end. So, please bare with me and don't ask too much as I really don't want to answer.

An acquaintance of mine, not super close friend but not a stranger, shot and killed a man. This person is a female and was kidnapped along with two of her co-workers. What the person didn't know was that of the three people he kidnapped, the female had a concealed weapon. According to all three victims, the suspect told them he was going to kill them all, after robbing them, and raping her. When opportunity presented itself, the female victim pulled her pistol and unload it into the suspects chest, killing him. They called the police, who showed up and cuffed everyone. They end up taking only her to jail and kept her half the day, locked up. One of the co-workers notified her husband who went to the police station, where they wouldn't tell him anything. Wouldn't even confirm having her. The husband threatens to get an attorney to which the station responds if he does, she will stay in jail at least 24 hours. (Yeah, that confirmed she was there then). After half a day goes by, theu finally released her. My question, is it proper protocol to take someone to jail even on a justified shooting? I know the police have to figure out what happened but they had three victims all telling the same story. Also, if they weren't sure the female was telling the truth, why wouldn't they arrest the two men as well? To clarify, before anyone asks, she was not asked to go to the station to give statements. She was cuffed and arrested, then later released.

Why? It wasn't me. Just someone I know. Just asking how it's legally supposed to be handled. What tragedy have I posted about in the past? I called 911 on a unresponsive kid on spring break. I was robbed several years ago at a gas station but what else?

They question while all accounts are fresh in the people involved minds and before they can't put their stories together. Let LEO do their job. Unless you are a lawyer(her lawyer) or LEO its none of your business.

F*ck it. Just forget it. I didn't "expect" a damn thing. I was just asking what the protocol was. I guess if her and her husband told me about it personally, that made it enough of my business to be curious as to how it's handled. And no, I don't know how the system works. That's why I asked.

Actually that has happened around here several times.
To my knowledge the person defending themselves has not been arrested or held for questioning.
Our DA will take the case to a grand jury in order to have the person legally cleared from any future indictment. But I guess it depends on the situation. Sounds to me like the officers had a good reason to suspect this wasn't a case of self defense.
Perhaps somebody is lying.

Or new Sheriff or DA. Those protocols change every election. If this is true I'm surprised she isn't being charged with shooting to kill and not just wound. Why isn't this ion the news?????>

I have a friend that killed a home intruder. The police questioned her on our sofa (she lived about 3 miles away). I asked does she need an attorney. They said no. They litterally congratulated her and gave her son a medal as he was in room with his mom when thug tried to kick down door and get to them. I guess it depends insituation?

It was on the news. I didn't say where it happened. Alabama isn't the only state I've lived but it happened several months ago. Due to how it was handled, they (the couple) just told how she was locked up. (I assume, due to legal advice, maybe) She has been cleared of all charges.

God forbid I’m ever in such a situation, but I’m talking to an attorney and said attorney will be with me as I give my statement.
My statement will be “It was self defense. I need to speak to an attorney before saying anything further.”
You have rights and the attorney is necessary to preserve those rights.
