So, turdhead signed executive orders changing the rules for trusts to purchase cans? mad mad Thought I was gonna go get a new one and just have to wait the 8-10 months...nope, now every trustee has to be printed, photographed, cavity searched and water boarded before you can even send the tax to apply for the stamp. ugh!

That went into effect last July and it was not an EO. It was widely publicized months in advance and folks flooded the ATF with Trust purchases before it went into effect so that their trustees didn't have to go thru the background check.

I don't like it either but I'm out of the game now anyway.


I firmly believe that a double gallows should be constructed on the East Lawn of The White House. Politicians who willfully and shamelessly violate their oath to uphold and defend the Constitution of the United States of America should be swiftly tried and, upon conviction, publicly hanged at sunup the day after conviction. If multiple convicts are to be hanged they can choose with whom to share the gallows or names shall be drawn from the hangman's hat to be hanged 2 at a time.

Well, what they didn't do was change anything on adding or subtracting a trustee after a NFA item is owned by the trust.

If the trust only has one Trustee at the time of application, there's nothing that says (to my understanding) that a trustee or trustees can't be added later without performing a background check. Once approved for a tax stamp, always approved, even if the individuals on the trust change. In AL, trusts are not filed with the state, so what happens to changes is between the trustees and is nobody's business, except when you apply for another NFA item.

Therefore, technically, only one person has to be fingerprinted on a trust application if you plan ahead. You still cannot add a prohibited person to a trust at a later date, as that would be a BAD idea and put all NFA items in jeopardy.

This is spot on. If you don't already have a trust, just put you on it. Once you get approved, amend the trust and add whoever you like.

Technically, if you do have a trust already established, I understand there is no rule or law that would prevent you from from removing members from the trust for a short period of time, either. You can always add them back later with their signature on a single page stating as much. Makes for more amendments to the trust, though.

With that said, because of the fluidity of a trust, llc, corporation, etc, the background check is silly for an entity.

Aight, guess I'm going the "I'm gonna ask legal advise here" route. I formed the trust, not to circumvent any policies...but to make it where my cuz or I could use the suppressor without the other being there. We're both trustees with the trust owning the can. If I understood it correctly, if I owned the can, I would have to be present when it was in operation? He has a copy of the trust papers and stamp...so he can use the can without me being there. This just happened to get done before the rules changed, I guess. Now, the trust is gonna buy another can (or I should say, the trust has bought another can)...but we have to jump thru all those new rules to even apply for the stamp? Should I just apply in my name at this time?

I had to do the fingerprints and photo last year when my cousin added me to his Trust. It took me 5 mins at the Sheriff's office here in Montgomery. I had done a Trust for myself a month earlier before the rule changed. It didn't take any longer to get his then it did for me to get mine.

Got all info and Form 4 sent off. The wait begins. First suppressor stamp application was a 8-9month wait. If what I'm reading on nfatrackerdotcom is correct...I'm in for a 12-14month wait this time. Ugh. I did read where they had whittled the ind application time down to about 5 months...and that they were taking resources and moving to trust applications. Maybe they'll get them caught up!

thumbup That's amazing! I never had an approval in less than 9 months. My first 3 Form 4s went in all at the same time and took 13 months.
