I think if I had pending felony charges if be more worried about hiring a good lawyer than buying a gun anyway.

You would probably be legally able to buy one but your conditions of bond or other stipulations from the judge may prevent it.

My layman's answer is NO, he cannot legally buy a firearm.

Once you are convicted of a felony I don't think you can legally own anything but a muzzleloader so it's a moot point or a waste of money. Doekiller can clear it up for you.

A friend of mine did something extremely stupid in the past month he was charged with 2 felonies on top of that he pawned his mother rifle. Today his dad took him to get it out. By law he had to fill out paperwork like you're purchasing a rifle. They have a hold on him for a few days

Pending is not convicted. Not sure if "presumed innocent" applies. But it should unless you're convicted.

I'll be VERY surprised if HE is able to get the rifle back. Computers are faster than the crook/IDOT sometimes these days. Evidently he didn't pawn it in the heat of the crime or I believe it would be held as evidence. I figure it will become property of the pawn shop and Pop will have to buy it back if he wants it.

The pawn show did tell his dad that if some reason he couldn't get it back that he could just come back up and fill out the paperwork and they will give it to him

THE LAW SAYS YOU CANNOT PURCHASE A FIREARM IF YOU ARE UNDER INDICTMENT FOR A FELONY. The law is clear.

It doesn't say you can't possess a firearm if you are under indictment. But, you cannot purchase one.

You can not possess a firearm if you are convicted of s felony or a misdeamenor crime of domestic violence.

There is another issue at play with this question.

If he answered yes to the question on the 4473, then he is going to get turned down no doubt. But, if he answered no, he is not under indictment for a felomy offense, then he committed a new federal felony by lying on the 4473.
