They have never been a problem until this year and we've already seen three. The sheriff doesn't give a damn but the game warden suggested we try to get pics of them trespassing. So if we ID these people and have them arrested, what happens next? Do I have to go to court or does the GW handle that part of it? If you actually have followed through and prosecuted someone, can you give me a general run down of the process? Please no speculators. Thanks

If you see them or get pics and ID them then YOU will have to go sign the arrest warrant. It will be served by the GW or a deputy. You will have to appear at court to testify about the facts of the case.

If the GW sees them then he will simply arrest them on the spot, and release them with an appearance bond(ticket) and he will go sign the warrant and appear in court to testify. You will not have to appear in court in this case.

I have caught folks several times and had them arrested and prosecuted.


I've spent most of the money I've made in my lifetime on hunting and fishing. The rest I just wasted.....

Yes..Had some trespassers come onto a property we hunt and over see for a family member that lives in Bham last year.She pressed charges and They were charged with criminal trespassing.We had to go to court.They each got a small fine +court costs and a year probation.. End of story

Bham Fred looks to be spot on.

Unless the GW catches the guy in the act, you'll most likely have to sign a warrant for his arrest and go testify. Your pictures of the guy trespassing will determine whether there is probable cause for the judge to issue an arrest warrant.


Not sure about whether you would have to go to court if the GW witnessed it himself and made an arrest. They might want you there to tell the court that it was in fact your land where the trespassed occurred, though.

We lease the property. Does that change anything?

You pay for it and have the paperwork to show don't you? If you leased a house you would consider it yours if someone came trespassing.
