If this goes to court, how can she prove the sample she took came from your place of work? Now I'll admit I don't know much about mold (thankfully), but can your pro's sample have identifying markers (kind of like DNA)? If so, I'd think you'd sure want to verify that her sample matched what your pro pulled from your building. Just my two cents. Her sample is worthless for anything other than getting someone to handle her lawsuit. A legitimte sample will have chain of custody paperwork showing when, where, and by whom it was collected by, what procedures were used to collect it, What means were used to evaluate it,and who evaluated it. I nailed it! Even a blind squirrel finds a nut every now and then!

If not, did she clock in while being on the premises?
What is the policy of not being scheduled to work, and showing up on the workplace premises?

So what if it tested positive. As long as there arent too many particles in the air then its useless. An air quality sample would have to be made and she cant do that. I know first hand about the dangers of mold. As mentioned above its everywhere and some people are more sensitive to it. As far as a lawsuit is concerned i wouldnt sweat it. My wife worked in a school that the sewer backed up and soaked the carpet and wood cabinets over the summer with no air. Mold was growing on the carpet,cabinets and behind the cabinets on the wall.the school sprayed some disinfectant and steam cleaned the carpet. She had several students develop asthma and many kept colds and sinus issues. The school refused to do more without being pressured. We sought legal advice and the lawyer didnt think it was a winning case. We bought a 750.00 air purifier and toughed it out until the school closed and my wife got transferred to another school. At the new building my wifes symptoms basically disappeared. Very good point. I knew this but had not thought about it. It's all about parts per million I think. Thanks for all of the responses. At least I'll have a little knowledge on the subject today.

Do y'all have a preventive maintenance program in place for the hvac systems? Cleaning the coils, drain pans etc..?

Problem is, when it gets this humid any cold air vent located near an entrance/exit door is going to sweat. When it dries it's usually going to form mildew.

Bottom line is her test is not valid. You might as well get one done now to head off any issues later.
EE's should not be allowed at work while on leave. If she is able to climb in a chair, 100lbs overwieight then she is probably able to return to work. Problem is you are going to make it look retaliatory at this point unless you address this with the entire workforce.
Did she access the property after hours?

Like others have said, mold is everywere.Inside and outside. I would recommend spraying with sporaciden disenfectant and vacuming with a hepa vac, and treating with sporaciden mold resistant coating. Now that the word "mold" has been spoken, the placeba affect will kick in. So you're doing the right thing by having an expert test for dangerous molds in the air.
