I have been parking on a deeded easement to my hunting land for 4 years. The new owner of the land that the easement goes through informed me that I can't park there anymore.
Is he right?

If it's deeded you can do whatever you want, temporary parking wise. Tell him to shove hot coals up his ass.


I firmly believe that a double gallows should be constructed on the East Lawn of The White House. Some easements only grant access to the land owners and not lessees.

If it is for ingress and egress only, that could be construed to mean you can not park there.

This. It is meant as a right of way for access...not to park. Could be he wants to hunt near where youre parked.

We had a lease one time that had an easement on it that only granted access and no parking whatsoever. I don't remember the details but the people driving across it kept parking on the side of the road and their access eventually was revoked.

An easement doesn't grant nor transfer title of ownership of real estate. It is a nonpossessory right.

I have an easement for ingress and egress only. I say I do but it is an appurtenance to the land. 30 ft. wide. Now what you can do is park on the county ROW and walk the whole way in. I'm not sure of the legal aspects of parking on the county ROW but I see people doing it all the time.

I bought some acreage that sits way back off the county road. It has a 30 foot nonexclusive easement deeded to the property. The only other property associated with the easemant was 4 acres that eventually became available so I bought it too. So, now I own the easement, no question about it. I hope I do't ever get pissed off at myself for parking on it and tell myself that I can't do it. Might have to write myself a ticket if I do wink

Pisses me off,last week there was a big 2500hd with a trailer parked on one of our roads that those guys have an easement through,he unloaded his utv and then drove into their property,they have a great road system so there is no sense in him parking on ours,unloading his buggy and then driving in

We purchased a piece of about 6 years ago that had an easement on the eastern side of property. Weyerhaeuser and 2 landowners had access thru. I spent a lot of money that summer for bulldozer work pushing bigger plots, fixing washed out roads, etc. Long story short when the season comes in, I go to sit on my plot closest to the easement. I was aware that there would be some traffic and nothing I could do about it but the hunters that leased the other tracts, all parked about 100 yds from my plot on the road, and had been doing this for years. I politely asked them to find another parking area and at first they were not happy and told me they needed to park here so they wouldn't ride in to close to their hunting and mess things up. I asked them if they thought it was ok to mess my hunting up and it's like they never considered that a problem. I got the feeling they think I'm a jackass for requesting they park on their lease.
With all that said the landowner might be an asshat bit give him the benefit of the doubt. Maybe he has had a few run ins with some others who abuse the easement and turn it into a Wal mart parking lot and landfill.

We've met, exchanged numbers and helped each other keep trespassers out. We're not like strangers.
He left hand printed double spaced letters on each of our trucks quoting Alabama law about easements, with our individual license plate numbers printed on them. Then signed them (OWNER). No doubt here...ASSHAT.

I would try a more tactful approach than he did. But if he's a Yankee, he can't help but act a fool on legal matters. They are just about all like that and I never get used to it.
