Why not just call your neighbor and say hey we have your deer over here if you want to come try to dart him or feed him into a pen or something. That's what I would have done anyway. Seeing as how everyone knew who the deer belonged maybe they will send him an invoice.

Personally, I have no problem with the kid killing the deer, but I wonder what kind of civil liability he, or his guardians, may suffer since he killed someone else's property. He acknowledges that he heard of the escaped deer and even saw the game cam photos so he knew it wasn't "wildlife", but a high fence deer, which is property.

Any opinion Doekiller?

Would seem to me that since deer is a legal game animal, the thing became fair game the minute it escaped from the enclosure.

Is it legal to import deer into the state and release them? Would the high fence owner be liable for breaking the law if it's not? (Asking cause I don't know, not being a smart ass)

Ownership ended when it left the "owners' property in my opinion. I would have probably shot it and I know for a fact that dang near anyone here would have when we were 17. Now the smart thing would have been to catch it and sell it back to the farm for a bargain price of $15.000

Are high fence whitetails considered property? You still have to follow wildlife laws and seasons. If he was legally hunting I see nothing the fence owner can do. They are not livestock so those laws wouldn't apply.

i would not kill it because i would not have it mounted , a pen deer .

Raise your hands if you have shot those (free range) fallow deer that have been talked about on here. Close to the same thing? If I knew old Joe had a deer missing and I could identify his tag I wouldn't pull the trigger right then, I would go home and get my other gun and hope I mixed the meds to the right formula for the dart.

I know some people that raise deer. They can't get insurance on them like people think. Since that deer had a tag, it was more than likely a breeder buck, so they are the ones that are somewhat tame. They are kept in the smaller breeder fences and come in contact with humans regularly.

One of our local enclosures had an elk escape one time and I was discussing with a high ranking GW what would happen to someone that shot it. He told me nothing criminal because it was a member of the deer family but there could be civil repercussions for shooting someone's property. That is why I brought up the possibility and wanted Doekiller's opinion.

I know I've read other stories about escaped deer being shot and the hunter is responsible for reimbursement to the owner the same as if it were any other livestock. Here is a story that mentions it.

For the record, I'd have shot that deer at 17. Today I wouldn't give a plug nickle to bow shoot one if it were inside a 100k acre enclosure. Just ain't my thing.
