AMENDMENT NUMBER FIVE (5)
Proposing an amendment to the Constitution
of Alabama of 1901, to amend Amendment
597, now appearing as Section 36.02 of the
Official Recompilation of the Constitution of
Alabama of 1901, as amended, to clarify that
the people have the right to hunt, fish, and
harvest wildlife subject to reasonable
regulations that promote conservation and
management of fish and wildlife and preserve
the future of hunting and fishing. (Proposed by
Act No. 2014-286)

Was this part added to the prior amendment that (merely) reaffirmed our God-given rights to hunt and fish and, if so, who determines what a "reasonable" regulation is? DCNR? Courts? The public?

Take out all the other jargon about reasonable regulations and I'd vote for it. I'm trying to figure out what's wrong with the rights we have now and why someone one thinks they need changing.

Are we having a problem currently having a problem clarifying that the people have the right to hunt, fish, and harvest wildlife subject to reasonable regulations that promote conservation and management of fish and wildlife and preserve
the future of hunting and fishing?

I'm always suspicious of any amendment that addresses an issue that isn't an issue. It's usually somebody trying to slip something in there that they know we wouldn't otherwise pass.

When "subject to reasonable regulations" is included that sounds like someone somewhere is tweaked about something they didn't get done or couldn't get done or they want to get done regarding some rules or checkpoints or limits or something and by sliding in four words it's possible to argue "well, this is reasonable in 14 other states" or "our people believe this is reasonable and common sense says it is" to get something done.

I will be out of town next Tuesday so I voted early. I had not herd anything about amendment 5 but after reading I voted no. I kept thinking about the mandatory check-in system and this seemed to me like a attempt to push new regulations.

"Reasonable regulation" is the verbiage I have an issue with. Our government's definition of reasonable does not align with mine.

This amendment was designed to be proactive against the wishes of anti-hunting groups like PETA. The goal is to preserve our rights and heritage expressly.

But as usual our legislation is poorly written.
