I wouldn't think so, but I'm not in HR, either. They could make them pay a higher rate for being insured than "healthy" employees...however that is determined. The surgery would be less than long-run insurance costs forked out by the company for the employee, due to less obesity related issues.

When I worked for Texas Instruments, usually once a year we would go through a RIF (Reduction In Force). Which means TI would say they had too many workers and had to lay off employees. But the layoffs would target the ones management did not want to keep around.
