I agree Texas native, problem is you have to prove that they knew they were trespassing. It’s easy to lie.

Y’all forget that the judges that prosecute them are elected. I know LEOs very well in certain counties (GW’s and deputies) that have stopped writing trespassing citations because the judges and DA’s don’t want to prosecute it because these people have to vote them in and it’s not a good look.

I went to the courthouse this morning since I had the license both of the people had. I gave them to the LEO official that was on the scene with me yesterday. I told him I wanted to make sure the one who ran was notified that since we proved it was him, if he is caught again on this property he will be arrested on the spot. LEO told me that when he left me yesterday they found their car pulled off the highway and basically hidden from view. They ran the plates and they came back not matching the vehicle they were on. He told me the plates had been switched and he left him his business card with a hand written note informing him of several things the runaway digger needed to do. The first one was to call the Sheriffs Office, but I bet he wont. He also said they would be sure their possessions I took to the police department were returned to the men.

As far as value of the goods they left behind, probably less than five bucks. A couple of broken arrowheads and a scrapper were all they had. No value whatsoever to what they had dug up. As far as the purple paint boundary line goes, I will check locally wife my firend who is an LEO and see what he tells me they can do if the line is painted.

One wallet did not have a dollar in it. I assume someone this broke dont even have a yard. One of the drivers license said Nondriver and another ID was for work release. We checked when we went through the backpacks to remove anything they had dug up. Talk about two world class leaders.

The purple paint can be used to mark no trespassing versus having a sign, and even then there is strict stipulation on how it must be marked or displayed. It literally does nothing else in the form of prosecution.

(4) Posting in a conspicuous manner.  A sign or signs posted on the property, reasonably likely to come to the attention of intruders, indicating that entry is forbidden or the placement of identifying purple paint marks on trees or posts on the property, provided that the marks satisfy all of the following:

a. Are vertical lines of not less than eight inches in length and not less than one inch in width.

b. Are placed so that the bottom of the mark is not less than three feet from the ground or more than five feet from the ground.

c. Are placed at locations that are readily visible to any person approaching the property and are no more than 100 feet apart on forest land or 1,000 feet apart on land other than forest land.

This pertains to the articles within criminal trespassing.
