Firearms transfer question

Firearms transfer question - 10/16/20 12:58 PM

Had an uncle pass away earlier this year and my aunt has finally gotten to going through all of his things.

He had 3 firearms she wants to give to me but wants to be sure everything is done correctly. It’s 2 hand guns and one rifle.

What do I need to do to help her with this? I am a Georgia resident and she is in Ozark, AL.

To the OP, my advice would be to go through FFL channels and transfer legally. I would advise that even if this thread did not exist but especially since it does exist.

Did you say your uncle made a trip to georgia about a year before he died and gave you three guns because his wife didn't want them in the house after he was gone? That's what I thought I heard you say.

If they’re your guns, then you can do a lot of stuff that the ATF has no say in (ie, there’s no law/reg against) you can have them shipped, directly to yourself, wherever you may be. You can transport them from wherever, to wherever you may be. Both are expressly PERMITTED by ATF. How they actually became your firearms can have some guidelines, but they’d have to prove they weren’t given to you or even bought by you, from an individual, years ago and merely stored elsewhere.....which, IF your relative intended for them to be yours, from way back, they WERE yours, way back. If they haven’t had an ATF form filled out on them in the last 7-15 years, then there’s likely no ATF-accessible record on them, until you create one. Individual transfers are still legal without any ATF paperwork. I’m not advising anything, except going by the letter.....only dismissing conjecture....both from others AND the ATF.

4473s are kept by the FFL for 20 years. If the FFL went out of business before 20 years the forms were sent to the ATF where they are SUPPOSED to be destroyed after 20 years

x3 some of yall are suffering from a type of paranoid condition. you dont have to explain to anyone how you got them its none of their business put them in the truck and drive home. who do you think is going to interrogate you and how will they prove you havent already had the guns for 10 years? are you under investigation by the FEDs is someone keeping tabs on your every move?
